    I like straight hair too.

    It’s really just a matter of the overall look and the way the personality of the girl blends with the look she is trying to pull off.

    The main thing for me is that a girl should take what she has and accentuate it to look the best she can without affecting her natural look. Unless it’s something you might call a ‘blemish’ don’t cover it up or try to change it, just bring out the best in the way you were created.

    Maybe other guys have different preferences. I never said I was typical.

    I am not coming to support the reasoning I used in that thread to be matir a microwave. That was just something I’d heard and did not go into well, and my rav’s reasons for being matir in that case have nothing to do with that.

    My point here was simply to say that it is incorrect to blanketly state that the halacha does not accord with the Rashba. This is for two reasons. 1) There are contemporary poskim who explicitly maintain that the halacha follows the Rashba. One such posek is my rav. 2) The Shach brings down (in the place I mentioned, and thanx Popa for your input) the pshat without bringing an argument. I know Tosafos in P’sachim is clearly not like the Rashba, and there are those who hold like that, however, ashkenazim generally follow the Shach, and though you have every right to bring a raya and argue, you cannot claim that there is some kind of halacha psukah not like him.

    Not exactly. If the bottom is hot (kli rishon) we say the heat transfers and the issur will then transfer both ways; e.g. by meat and milk they will both become assur. See the gemara quoted above by jewish source.

    I have no objection to the Sears case. And I feel deeply for anyone who is indeed a victim of anti-semitism.

    My point was to agree with real-brisker, who in my opinion made a very valid point in his first post, when he wrote, and I quote: “A company can tell you if they want you to work only mornings, only a few times a week, and only on certain days. If you don’t like it don’t work for them!”

    If there is evidence that the company in question is motivated by antisemitism, as in fact later posters have implied, then yes, I think this company should be sued and prosecuted to the full extent of the law. My intention was only to side with the general notion of the statement previously mentioned, as I did not feel that the bashing he got was warranted. This is because I do believe there is a trend in some circles to cry antisemitism about anything and everything, as in the garbage truck anecdote.

    However, seeing that there seem to be legitimate grounds to make this claim here, kol hakavod, and the point I made is not relevant to this particular case.

    Please. I don’t think you should have to ‘take’ anything, and never implied otherwise. Everyone is entitled to demand that they not be discriminated against, and if what is happening is indeed discrimination then by all means go ahead and make a big deal about it. I don’t think we are living in pre-war Europe or the middle ages.

    HOWEVER, my point is: There are organizations such as the NAACP, which, though they defend a worthy cause, are often subject to being subtly mocked and looked down upon in pop culture and the media, not due to latent racism, but simply because among the righteous causes they defend they also seem to sometimes make a stink over pettiness. Similarly, by Jews getting together and crying anti-semitism over pettiness and what is regarded by the average thinking American as not religiously discriminatory in the slightest, generates a public opinion that looks down upon us.

    No, I am not worried that someone will get locked up for saying something against the ‘establishment’. But sometimes we do wish to have public opinion on our side, and this kind of thing, in my humble opinion, ruins our chances. And besides, when the general public sees us as petty, I think it is a big chillul Hashem.

    Sure pipe = sophistication. In a retro way. You just need a fitted tweed jacket and a nice brown kangol cap, maybe grow a mustache, and make sure to wear large, black, horn-rimmed glasses. Nothing truly goes out of style. You just need to do the look right and you’ll pull it off. I like to try that look sometimes. I stick to cigarettes though. I know, I really need to stop. I’m working on that.

    You haven’t responded as to whether you are well versed in the Rambam’s works. I assume you are not. Take a look at the last of the 8 Perakim, you will find that the Rambam understands ??? ???? ???? ??? ????? ???? to mean that every action that is a lav or an aseh is fully within one’s bechirah. That is, it isn’t that Hashem gives us bechirah, or an illusion of it, in instances in which there are mitzvos. It’s the other way around, there are certain things which Hashem originally gave man full autonomy over, and those are all of his actions, and because that is so, he gave us mitzvos in those areas. Look it up and think about it.

    I completely agree with real-brisker. It’s like when the garbage trucks don’t come due to the legal holiday, and people cry “anti-semitism!” It makes perfect sense for a company to require an employee to work on Saturdays, and if you can’t do that, then either don’t work for them, or make yourself valuable enough to them that they have to accept your terms. But crying anti-semitism and filing lawsuits is, in my opinion, counterproductive, for maybe it helps in the particular case, but in general I think it makes people think that the Jews are taking advantage of the Constitution to push their own agenda. Also, to the general public which does not see this as anti-semitism, they see the Jews crying wolf, and when something comes up that is a real problem, they wont be on our side.

    I had the same experience. To put it bluntly, I found the Rambam (the Moreh, Chelek, 8 Perakim, Letters, Mada…) much more – I want to say intellectually honest but I’ll be politically correct and say – much more intellectually stimulating than much of the current literature. The only problem is that much of his hashkafah is not accepted today, at least not where I live. It’s not that I really care, but it becomes a problem when, e.g., a kid has a question, and I have to worry that if I answer him in a way that I think makes most sense and is actually mefurash in the Rambam, his father will come banging on my door because I am indoctrinating his kid with hashkafos inconsistent with the ‘mesorah.’ Which is fine, I get that. It’s just frustrating not to be able to help people. And the worst is when someone asks me to ‘prove’ a concept to someone with ‘questions,’ and I have to argue with the guy that this ‘concept’ has no proof and in fact I don’t see any need to command a belief in it. Alright, that’s my rant for today. Now everyone can pounce on me for being a kofer.

    I don’t think there should be any inherent problem, however, if when you receive a text or a call it will show up while you are davening then I think it is not appropriate because it will disturb your concentration even if it is on silent.

    Hebrew National is kosher according to my rav, political issues notwithstanding. It is only because we are noheg to be machmir on glatt that we don’t eat it, but as far as the hechsher goes my rav says it is reliable.

    I haven’t looked at the Ramban inside and I don’t know the exact word he uses which you are translating “to inherit”, but I just wish to point out that the word ?????? is often used in the Torah to mean ‘to conquer’ and not to inherit. There are many examples, I can find them if you’d like.

    It seems to me to be infected by the very things that mdd accuses.

    I am not going to take issue right now with that generalization. Let me just say that I do think in some cases you might be right, but it depends on the posek/rabbi, and personally I think one could say the same thing for some ‘ultra-yeshivish’ rabbanim, (though of course to the opposite extreme) so I think it is not really fair to generalize like that.

    However, ???? that that’s the way it is, like mdd describes; for arguments sake. I am bothered by the fact that he simply discredited everything I wrote without even reading it. I did not find an obscure rishon to rely on. I used standard sources and a regular approach to analyzing the sugya (by regular I mean that I am sure none of my rabbeim in the Mir, Ner Israel, or Lakewood would say I’m being ????? anything, and my much-more-“normal”-than-me chavrusas were also ???? to what I said), yet I get dismissed with a flip of the hand at best, because apparently I have an agenda.

    I guess I am appealing to you because with all due respect to others on this site, I think you know better than most here, how to properly learn a sugya and pasken a shaila. So if you happen to have the time to read my lange drosho, let me know what you think.

    About the Terumas Hadeshen, open your eyes and stop being so closed-minded. He specifically ‘bavorns’ the fact that the gemara says ???????? by saying it just means a ???. How can you possibly say with a straight face that he really holds there is a ???????? level involved?! What in the world was he ‘bavorn’ing then?! Isn’t there one person on this forum who agrees with me that this claim of mdd’s is narishkeit?

    And no, I will not gratify you with a summary of what I wrote. I didn’t write lengthly because I enjoy writing megillos, I did it because it’s the only way to properly understand how I see the sugya. You want to label me and make blanket uninformed statements about my opinions, go ahead, I ain’t gonna help you.

    But just so you know, the d’rabbanan point really had nothing to do with what I wrote. What I wrote works just as well with those who understand the Gemara k’pshuto, that a partial covering is d’oraisa.

    However, I learn three sedorim a day, and I know how to learn a sugya. Yes I can make mistakes, but I am not full of garbage. I might sound like I’m bragging, but it has to be said, because I need you to understand that I do not ‘drei up the halacha’.

    If you have a problem with what I am saying, then please have the respect to read everything I wrote, and respond to my arguments in an intellectual fashion. If you don’t want to or care to, then do not issue blanket statements discrediting what I have written when you have no clue what it is.

    I am fine with you saying that your rav disagrees. And I am fine with you presenting an argument contrary to what I have presented. But stop with the bashing. I am not some guy who just makes up things to support an agenda. So please don’t treat me as such.

    Oh, and btw the Terumas Hadeshen is mefurash that according to the Rambam covering hair is not d’oraisa at all. I reiterate this though I mentioned it in the last thread, because the pshat you suggested for what he means is altogether inviable. His exact words are:

    I do not have any other usernames, my intention was that I posted this point more briefly on other threads (as rabbiofberlin noted) and it didn’t seem like too many people ‘heard’ me.

    As for your point about the shirt, it is a valid point, but the question is not a question according to the arguments I present in my long megillah.     I think I am being more generous than you in what I am defining as ‘relative’ ervah, but before arguing with me please be me’ayen in the Gemara that brings down that mishnah in Challah.

    As for your final point, yes, that is what I was trying to say. I believe that the Gemara in Brachos is not d’oraisa, and ‘das yehudis’ is based upon it, but ‘das moshe’ which at least in some way is d’oraisa is unrelated, which is why ???? ?? ??? ???? has no place in the Gemara in Berachos.

    The Ervat Davar is the hair.

    There is an unrelated Gemara (Kesubos 72a) which states that a woman is not allowed to go out with an uncovered head, and brings a pasuk, ???? ?? ??? ????, which from the context of the passage in the Torah it is clear that it was done in order to denigrate the woman who is a sotah, so we learn from there that for a woman not to wear a covering on her head when she goes out is derogatory to her.

    Note that the Gemara in Kesubos which makes the derivation from sotah never once mentions an obligation to cover the hair, rather to cover the head.

    Also, note that the Gemara in Berachos which is attempting to prove that the hair of a woman arouses a man, brings support from a pasuk in Shir Hashirim, and not from a pasuk in the Torah, which would have been a much better proof. If the reason a woman must cover her hair is because it is attractive to men, then we have a source from the Torah itself, i.e. ???? ?? ??? ????.

    There is more to say, but for now suffice it to say I think it is clear from these and other points that the two Gemaras are not related, at least not on the surface level.

    The Ritva at the end of Kiddushin says that the halacha follows this Gemara. However, he says that one should not rely on it if he is not a ???? ???? ????? ?????.

    Let me explain. Those who maintain that a woman must dress a certain way generally source their claim in the fact that the gemara calls certain body parts ervah. There is a lot of room to say that those things are subjective and have everything to do with time and place. The hair covering halacha, on the other hand, is not just because of that gemara which calls hair ervah. Therefore it is more difficult to be mattir.

    Short sleeves are way easier to be mattir then uncovered hair.

    I’m not paskening, only saying that when you are analyzing the sugyas and the halacha it is much easier to be melamed zchus on those who wear short sleeves, pants, etc. than those who wear their hair uncovered.

    I am actually curious to know if you can find me one clear source in the gemara and rishonim that any dress code is required, apart from not dressing in a markedly provocative manner.

    Whether negi’ah is assur mi’doraisa, mi’d’rabbanan, or even muttar, is a machlokes amora’im in Shabbos (13a) and Avodah Zarah (17a).

    Assuming it is assur, and it was mentioned that the Rambam paskens it is d’oraisa, it is a fence put in place to distance one from the actual act of giluy arayos. (Yes there are fences that are d’oraisa. The classic example is the prohibition of a nazir to eat grapes.)

    Covering hair, IMHO, has nothing to do with arayos. I once wrote an essay on this and I had a number of problems trying to say it is indeed because of ervah,* and the truth is you wont find me a single rishon who explains it this way.

    And by the way, the Rambam who learns that negi’ah is d’oraisa, understands that covering hair is only d’rabbanan. The Terumas Hadeshen (1:242) writes: ???? ????”? ????? ??? ???? ???? ??? ?????? ??????.

    No, that is not what I am saying, and thank you AOM.

    I don’t wear jeans because it is not in accordance with the dress code of the yeshiva. The dress code is to dress formally, i.e. white button down shirt and dress pants, and jeans do not currently fit that category at this place and time. When I am on vacation I do not dress this way specifically, because all it is is a dress code for my yeshiva. This past summer I walked around one day with plaid shorts, a T shirt, and flip flops, and another day with my white shirt and dress pants, because aside from the dress code issue I have nothing against wearing whatever I want. Would you understand what I am saying better if I would say I don’t wear jeans because I am a police officer and it is against protocol? You seem to be stuck on making me out to be a two faced hypocrite. Maybe you’ve had experiences with such people, but that isn’t a reason to assume everyone is like that.

    real-brisker, I don’t because I am in yeshiva and the dress code is to wear dress pants, but I have no halachic or hashkafic objection to wearing jeans, and I would probably do so if I had a different occupation.

    I don’t really know what the sheilah is and I haven’t seen the teshuvos, but according to the gemara in A.Z. (33b) it comes out that one may leave beer (and ?????? whiskey would be the same according to all the rishonim and perhaps even better ?”?) in a cask that previously held wine of a goy, and the mechaber (Y.D. 137:4) is mattir with all drinks.

    First of all you’re oversimplifying. But personally I’ve read a few of the essays written by the great existentialists and I’m still not sure exactly how to define it. I don’t think it focuses on the question of are we real, as much as what am I (presupposing and not really focusing on the existence of ‘I’) and what is the meaning of life.

    As for your question regarding simulation, I don’t know why you need to get so sophisticated. We all dream, and while dreaming, aren’t aware that what we are experiencing is reality. So whose to say that this is reality?
