New York City lawyers say the death of a woman in the 2010 blizzard was “solely an act of God.”
Kathleen Thomas died the morning after the Dec. 27, blizzard in Lower Manhattan.
According to court documents, after slipping twice she said she feared she was having a heart attack.
She died before EMS arrived, two hours later.
Thomas’ family sued the city last September, charging it did a poor job plowing the streets. They said that delayed the EMS, which directly led to her death.
According to the Daily News, the city argued Thomas should never have been out in the blizzard. Its lawyers said Thomas “knew or should have known” the risks.
Thomas’ brother, Simone Pascal, said he believed the family had a strong case.
