High Court Prevents the Demolition of the Homes of Terrorists Who Assisted in the Murder of Dvir Sorek HY”D


Dvir Sorek HY”D was murdered in August 2019 as he was traveling to his hesder yeshiva, located in the Gush Etzion community of Migdal Ohz. He was bringing seforim for his rabbonim, a goodbye gift as he prepared to leave yeshiva.

Sorek’s murderers were apprehended within 48 hours, and IDF explosive experts mapped his home in preparation for demolishing it.

However, the homes will not be destroyed at present, as High Court Judge Uzi Fogelman accepted the position of petitioners on behalf of the families of the terrorists on Wednesday, issuing a restraining order preventing the demolition of homes despite the fact the final approval to do so was given last week.

Five terrorists took part in the murderous attack two months ago in which IDF Corporal Dvir Sorek HY”D was stabbed to death heading to yeshiva. Two of the terrorists actually murdered him, while three others assisted in the attack. Demolition orders were issued for the home of the two murderers along with two of the three who assisted. While the IDF Central Commander signed the final orders last week, the High Court on Wednesday, October 23, 2019, issued an order placing the demolitions on hold, permitting the families to appeal the planned move.

The Betzalmo (בצלמו) organization is representing the Sorek family, expressing outrage over the court’s interference once again, decrying what they call a “miserable absurd decision by the court”.

They explain this is not a monetary dispute in which both sides must be heard by the court, warning any delay in carrying out the demolitions simply serves as “fuel and a prize for the families of the terrorists”.

They are calling for a new norm, that if home demolitions are contested, the hearing take place immediately, or within no more than 48 hours.
