There is a sigh of relief among rabbonim and talmidim alike regarding the building of Beis Medrash Elyon in Bnei Brak. After a long period of uncertainty and fear of canceling the building permit for the yeshiva, in light of a provocative claim by one of the residents of the area, the various courts rejected the claims and construction will continue as usual.
The decision results in a green light for the construction of the “Beis Medrash Elyon” in Bnei Brak. It turns out that a few years ago one of the residents of the neighborhood appealed against the plans for the construction and expansion of the beis medrash, which has become one of the leading yeshivos in the Torah world, with hundreds of talmidim knocking on its doors each year.
The suit was filed in various courts, including the Tel Aviv District Court and the Supreme Court, and was rejected, with the yeshiva represented by attorney Shoshana Glass. A few days ago, the District Planning & Building Appeals Committee finally rejected the provocative claim and now the Beis Medrash will be built as planned. Recently, the final permit was granted for the construction of a three-story building above the basement at 68 Uziel Street in Bnei Brak for the yeshiva students.
The local planning committee seems to have rejected an appeal on a technicality, that it was filed past the deadline.
