Rison L’Tzion HaGaon HaRav Yitzchak Yosef has once again spoken out against Israel’s civil court system, not sparing words of criticism and contempt. He stated that in some case, the court are “worse than the goyim”, citing how all too often Torah law is not only ignored but “booted out”. Rav Yosef targeted former President of the court, retired Justice Prof. Aharon Barak, who he stated should be treated as a “broken shard”.
He warned, citing halacha prohibits adjudicating matters in such courts and the ideas and policies of former Court President Barak are not to be followed but opposed, as was done in the 18th and 19th centuries against the Haskalah Movement. Barak told Yediot that efforts to transfer additional authority to the batei din, to adjudicate monetary matters if both parties are in agreement, was nixed by the High Court.
Barak spoke out against the nation’s batei din, making it clear in his viewpoint, the civil courts are superior.
Speaking to dayanim at a Halacha Conference, Rav Yosef spoke of Barak’s policies, which he feels much be opposed as they are contrary to halacha and represent secular coercion since the parties are compelled to have their case heard in a civil court.
Rav Yosef spoke of cases in which secular court overrule rulings of batei din, and how this is tantamount to “kicking the Torah”. Rav Yosef calls on lawmakers to hear his words and vote in favor of transferring this authority to the batei din in what he views as a “continuing the struggle against Haskalah that was waged 200 years ago.”
Barak feels the civil courts are defending the weaker litigator, usually the chareidi women, for her position in the batei din is quite precarious at best.

A cheap excuse to protect the corrupt Batei Dinim, who they themselves are kicking the Torah. On the contrary, if Batei Dinim would show true justice, than I would agree. Justice is suppose to be Blind!!!! Unfortunately, If you are one of them, your set!!! If you are not in their circles, forget about it. The Secular courts ARE the ONLY TRUE protection against these corrupt Batei Dinim !!! Secular Judges are not perfect, but they don’t have Kollim to support !!!! Sadly to say, I have seen my share of corrupted Batei Dinim, and will never ever go to one. BeEzrat Hashem, with the return of Mashiach, Trust & True Justice will prevail. Clean up first the Batei Dinim, so theri would have to be “continuing the struggle against Haskalah that was waged 200 years ago.”.
