In yet another major Chilul Hashem, the Petach Tikvah Family Court has ruled toeiva couples may be fully recognized as parents of a newborn child. The court feels there is no ‘relevant difference’ between heterosexual and toeiva couples that would compel unique procedures for the latter.
Justice Yocheved Greenwald-Rand agreed with a petition filed by attorney Daniela Yaakobi, citing the best time to register the child’s parents is immediately after birth. Hence, both partners in a toeiva arrangement will now be automatically registered as parents, with regards to all legal rights associated with that distinction.
Previously, toeiva couples were required to obtain court-issued parenting orders after the child’s birth to establish the legal status of the non-biological partner as a “parent.” The partners were required to present evidence that they had been in a relationship for at least 18 months prior to arranging the parenting order, and that a parenting arrangement was in place before the pregnancy, amongst other procedural requirements. During the judicial process, only the biological parent had legal standing as the child’s parent.
The court stated its opinion that toeiva couples fulfill a “common and blessed vision” R”L, and that there is not a ‘relevant difference’ that justifies the application of various procedural differences for this kind of relationship.

I think Israel may come to regret this.
Even marginally committed Jews in Chutz Le’Oretz are cool towards the “gay” thing, mainly because they want grandchildren.
We are a family-oriented community. Gay children is the last thing we want, even if we can’t publicly admit it
But, amongst ourselves, Israel’s public institutions needs to grasp this fact or risk further estrangement from diaspora communities.
I am glad that the YWN bought this up to let the Jews worldwide realize
to what depths the secular public have fallen to allow such marriages to be called legal.
It is up to us to shout and protest over this grotesque decision by the court,and to yearn
for the day that Mashiach comes ,may it be soon,and see normalcy restored to the world.
