Israel: High Court Issues An Interim Order Blocking Regulation Law


Judge Neil Hendel issued an interim order on the implementation of the Regulation Law, which does not allow the state to take any action on unregulated land, including expropriation and demolition of buildings. Supreme Court Justice Neil Hendel issued an interim order today, Thursday, at the request of Attorney General Avichai Mandelblit. This is because the target date for the law has already passed.

The significance of the order is to leave the existing situation intact so that no action on unregulated land in Yehuda and Shomron can be carried out. These include expropriation, planning, registration, seizure of land that is defined as a private Palestinian for the benefit of the state, as well as the demolition and evacuation of structures located in such land.

The interim injunction was issued in response to a petition filed against the Regulation Law on behalf of 17 Palestinian local authorities in Yehuda and Shomron, whose lands may be expropriated by law.

The Binyamin Regional Council, which was one of the respondents to the petition, opposes the interim injunction, saying that “any delay in the full implementation of the law increases the duration of the violation of the council’s residents’ rights, including the right to dignity, property, education and equality, Residents.”

The Movement for Governance and Democracy said that “the High Court’s decision does not respect the law. A single judge, without a hearing, and in a decision without reasons, issued an order this morning that froze a Knesset law for an unlimited period of time. ”

According to the director of the movement, Yehuda Amrani, “This is a blatant disregard for the laws of the Knesset and the will of the people and a disregard for the Knesset’s orders.

MK Shuli Muallem Refaeli, one of the initiators of the law, said that “we again see how the separation of powers is trampled by the High Court of Justice.”

“The struggle against settlement in Yehuda and Shomron and the existence of the State of Israel is not only carried out by terror and incitement, but is carried out through exploitation of the judicial system,” she said.
