Justice Minister Speaks Of The Need To Permit The Knesset To Legislate Without High Court Interference


In an interview with the Israel Bar Association “Orech Hadin” magazine, Justice Minister Ayelet Shaked feels there is a likelihood the Knesset will have to restrict the authority of the nation’s High Court of Justice. Shaked, like many other ministers and MKs feels the judicial system has overstepped its authority by permitting itself to rule on matters that must be legislated by Knesset and its lawmakers, not the High Court, including matters of security.

Shaked added that all too often an investigation is taking place under the authority of the district attorney or attorney general and at the same time, a petition on the matter is filed with the High Court. She feels such petitions should be refused pending the outcome of the investigation. She is not pleased with the fact the High Court has extended its judicial reach to anything and everything, having the final word on most matters as a result of the successful efforts of former Chief Justice Aharon Barak, who during his tenure brought the court to a new level of supreme authority.

She also expressed opposition to the court’s system of appointing a new chief justice based on seniority. She feels such an appointment must be based on qualifications and not seniority.

  1. She is 100% right. Aharon Barak imposed Leftist tyranny on Israel with his outlandish judgments. It is a total violation of
    Democracy and contradicts majority rule. In Israel, there is no constitution to use to provide a standard and it’s up to the boich sevara of the out of control judges. Even in America, Leftist judges make up their own rules as they go against the will of the majority.

    May Hashem grant her success in getting the law to change so that a Democratic vote can overturn the foolish judgement of a misguided judge.
