High Court: 2 Week Jail Terms in Emanuel Case


Supreme Court Justice Justices Edmond Levy, Edna Arbel and Chanan Meltzer announced their ruling on Tuesday afternoon in the case of the Emanuel Beis Yaakov School. The court ruled that any parent who does not send its child to the school, in contradiction to the court’s ruling, will be sent to jail for two weeks.
 
The court reiterated once again that its ruling ordering the girls back to school is non-conditional, not on any other outside party and therefore, the contemptuous behavior of the parents will no longer be tolerated.
 
The court points out measures taken to date to compel compliance with rulings have failed, and therefore, jail is being used as a compelling factor towards parents adhering to the court.
 
Therefore, any parent that does not inform the court by 4 Tammuz (June 16th) that he is not agreeing to comply with the court’s earlier ruling to send the girls to the school will be placed under arrest and be remanded for two weeks beginning on June 17th. The ruling refers to fathers, not mothers. The state will use all means at its disposal to collect fines that have been levied to date.
 
In its written decision, the court also makes reference to the Slonimer Chassidus, since parents explained they will follow the Rebbe Shlita, pointing out that the previous Rebbe ZT”L in his sefer Netivos Sholom, speaks of ‘deraceha darchei noam v’kol ne’sivoseha shalom’.

  1. sorry people, but if we didnt want this to happen, we had lots of time to work on achdus and work this through a beis din where the greatest gedoilim of out generation could have sat. ‘what you ask for is what you get’

  2. In all my years I have never seen parents being forced by the state to send their children to any school. You could always choose private or public school. If a judge in the USA forced Jews to send their children to any certain school the entire world would be up in arms about it. Including Israel. This person who calls himself a judge is legislating his political wishes upon others. That’s not law, it’s ideology. We can see who should be running things. Not these guys.

    We must have our Gedolim lead our lives not the state of Israel, because when the state is involved see what happens

I don’t get it, here in the USA we have separate school for the Sephardi and Ashkenazi students, they have many differences in the way they live according to Halocha, i.e. eating rice on Pesach etc. so why can’t it be understood in Israel that they need separate schools just like in the rest of the world.

    Next: who gives the right to the Israeli secular court system to advise the religious Jews as how to educate their children? the court is governed ONLY by those who could not care less about the Torah laws, and the community in Emanuel are Torah observers, the right thing would be to put this situation in the hands of the Gedolim and ad-hear to their Psak.

    I think what the Israeli government is trying to do here, is the following; they are trying to get their hands into the religious schooling system (boys and girls) and slowly sway them from the Torah way of life, as the government has done in the past, It’s scary but if the court wins on this one, they will continue to destroy all the religious schools in Israel, give them some time and the job will get done, the only choice will be is to close ALL of the religious schools who are supported by the state of Israel, before they have a chance to Chas VeSholom bring down the rest of Klall Yisroel.

    In my opinion it might be a great idea to consider the idea of Home schooling, this way you know exactly where and what your child is up to. There is no other alternative to this horrible decree.

    We are in living in the days of the arrival of Moshiach and the Yatzer is doing what ever he can to destroy the small amount of Yiddishkite still left in the world, we have to be strong and Daven to Heshem, ONLY Hashem can and will help us greet Moshiach.

  4. samech tet; you might call the charedi school system corrupt but it is trying to educate its students. Look at the secular israeli school systme and it makes you want to cry. Knives, guns, etc are brought to school it is worst than in Harlem or the South Bronx. We have the right to educate our children the way we want. Nobody forces you to follow. Most of our children continue to live in Eretz Yisrael; where are yours, most of our marriages last where are the secular, where do you vacation and ask where we vacation,Who has the most amount of abortions in Eretz Yisrael; and on and on

  6. Today, June 15, the parents of the Beis Yaakov Chasidi were subpoenaed to the Supreme Court.

    None were allowed to speak. Non were cross-examined.

    How can anyone be jailed without a trial and cross-examination?

  7. #7 In the Communist country of Israel this *IS* the Democratic court system by the self elected anti torah judges in the high court and municipal courts. Next they’ll force the chareidim to join with the secular in the public school.

  8. Kol Hakavod to ALL the parents of the girls. Stand strong and united !!! You are being viewed as an example by showing the world what religious Jewish parents are all about.

    Kol Hakavod….b/c They are dedicated to their childrens education 100%, No Supreme court or any other organization will rule over the decision of the leading Rabbis.

    The Rabbis are our REAL leaders and we follow their advice.

    Now the judges of the supreme court should learn the meaning of ‘Daas Torah’.

  9. HOT OFF THE PRESS

    Just been announced that r eliashiv shlita was briefed tonight and said he couldnt believe this would happen. He announced that every person has a chiyuv to go out and escort/ dance these parents who are being moiser nefesh for their childrens chinuch. Plans are currently being made for half the parents to leave from yerusholaim and half from bnei brak to the prisons. This will be led by gedolim, rebbes, roshei yeshiva and thousands of bnei torah! How can we not encourage these parents (and some are going with babies) who are leaving their children for two weeks!
