The Ministerial Law Committee on Sunday, 12 Cheshvan, unanimously passed the Regulation Bill initiated by Likud MK Yoav Kish along with Bayit Leumi MKs Shuli Muallem and Betzalel Smotrich seeking to legalize Amona and other homes and outposts slated for demolition throughout Yehuda and Shomron. The bill is the legislative response to the High Court of Justice ruling, which compels the destruction of the 40 family community by the end of 2016. The court accepted the petition on behalf of Arab families that maintain the community was built on their private land.
During the weekly cabinet meeting earlier on Sunday, Prime Minister Binyamin Netanyahu did his best to persuade and pressure Bayit Yehudi to hold off for at least a day, but party leader Minister Naftali Bennett and Justice Minister Ayelet Shaked were unwilling to comply and moved ahead – presenting the bill to the Ministerial Law Committee.
The bill must still earn Knesset approval and if passed, the backers are hopeful it will prevent the expulsion and destruction of Amona and other communities which will retroactively become legal.
During the weekly cabinet meeting, Attorney General Avichai Mandelblit expressed his opposition to the bill, explaining it is problematic from a legal standpoint and it is likely that if passed into law, opponents would turn to both Israel’s High Court of Justice and the International Criminal Court in The Hague.
Prime Minister Binyamin Netanyahu explained the state has requested a six-month extension in the demolition deadline for Amona in the hope of arriving at a solution during that time period. He stated that if the ministers move ahead with the bill, the High Court, which has yet to respond to the request for a delay, is likely to reject the state request in response to the actions of lawmakers.
