The High Court of Justice on Sunday, 17 Menachem Av rejected a petition filed by a human rights organization on behalf of a terrorist involved in the murder of Otniel resident Rabbi Miki Mark HY”D. Mrs. Chavah Mark, his wife, was left critically wounded in the attack and a number of their children were less seriously wounded by the gunfire in the drive-by shooting attack as well.

The “המוקד להגנת הפרט” organization took the case to court in the hope of preventing the demolition of the terrorist’s home. The court was told the family was unaware of the planned attack, and therefore it should not be punished for his actions.

Justice Noam Solberg explained the court will not become involved in what is a military matter.
