The President of the military court presiding over the trial of IDF soldier Sgt. Elor Azariya, Colonel Maya Heller, on Sunday 15 Iyar decided to accept a request from the defense counsel to disqualify one judge on the panel of judges because he is a close colleague of the IDF Hebron Brigade Commander Colonel Yariv Ben-Ezra. Azariya is the soldier who shot and killed the wounded terrorist who was on the ground following a stabbing attack in Hebron on Purim.
Despite objections from the prosecutor, the court decided to accept the request to disqualify the military judge that was filed a number of weeks ago.
Three weeks ago it was made known the military prosecutor’s office called up reservist attorney Nadav Weissman, a senior partner in a major Israeli law office to lead the prosecution in the case, signaling the prosecution of the case is a high priority for the military prosecutor.
Many feel the decision to move ahead with manslaughter charges against the soldier marked the beginning of the breakdown in relations between Prime Minister Binyamin Netanyahu and Defense Minister Moshe Ya’alon, leading to the latter submitting his resignation.

Pray for this soldier, that the Zionists in their haste to appeal to the umos halom not torture him and let us daven that our fellow dati (religious) brothers leave the tuma of the IDF and join us in the beis medrash.
Interested to see how this case turns out. In USA police are under scrutiny for beating up a surrendered speeder with previous charges who was speeding past neighborhood schools and could have killed somebody.
No hard feelings for terrorists of course, but soldiers shouldn’t get away with breaking their codes imo.
I mean, no hard feelings against killing terrorists. Terrorists should be fair game.
You are so wrong, dikduck. Not only should terrorists be blown to bits, Sgt. Elor should be given a medal. This prosecution is another attempt at appeasing the PA. Who remembers the image of a terrorist standing at a window displaying bloody hands, grinning from ear to ear that he and others ripped 2 Israeli soldiers apart, while the ecstatic crowd cheered? And MY government prosecutes an honorable soldier? I am beyond nauseated.
This young soldier was newly drafted and should not have
been placed in such a highly dangerous and sensitive location. He really thought that the terrorist was about to detonate a explosive belt and as such acted properly.
The case you mentioned in the US sounds like he had already surrendered and stopped speeding. This terrorist was still alive and in a position to explode himself and those around, as serious wounded terrorists have done in the past.
If we worried less about the terrorist’s lives and more about ourselves we wouldn’t be in such a mess. And so many of our people would not have died.
I said terrorists should be fair game computerbubby, and it is my opinion that bad Israelis be punished as well!
Bad? I hope you get a “bad” Israeli when you have a problem.
