Refael Morris runs the organization called “Returning to the Mount”, an organization that encourages visiting Har Habayis, the permitted areas, in line with halachic guidelines. Morris was detained and questioned by police, apparently in connection with a new effort, offering payment for persons willing to go to Har Habayis and daven.
Morris was arrested for soliciting others to commit a crime for non-Muslims are prohibited from davening on the holy site. Morris denies the allegations against him, expressing harsh criticism against Israel Police for questioning Jews who are working to encourage Jews to visit Har Habayis while Mourabitoun women who harass Jews visiting the site are permitted to return despite their provocative actions.

Something doesn’t add up in this story. There is NO crime in the Israeli penal code against non muslims praying on Har Habayis. It’s the Waqf’s rules.

If you really follow Halacha, then you might have been unaware that the Mishnah Berurah (561:5) states, “Even after the Bais HaMikdash was destroyed, the Mount upon which the Bais HaMikdash stood still retains its special sanctity. Therefore, today, while we are all in a state of tumah, ritual defilement, it is strictly forbidden for a Jew to enter the Temple Mount.”
