A New York State trooper had the law on his side when he shot unarmed escapee David Sweat, apparently in the back, as the convicted killer ran toward a forest near the Canadian border.
Law enforcement experts say state and federal law allows officers to use deadly force to prevent an escape if the suspect poses a significant threat. And experts say this shooting was clear-cut.
Sweat’s accomplice, convicted murderer Richard Matt, was shot and killed on Friday, but Sweat eluded capture for two more days.
Sgt. Jay Cook was alone on Sunday when he came upon Sweat on a road less than 2 miles from the Canadian border. He fled, and Cook shot him twice.
