Finance Minister Yair Lapid announced a number of weeks ago that he wishes to improve conditions at Kever Rashbi by handing over exclusive control of the tziyun to the state committee established in 2011.
The Rashbi Yeshiva in Meron has filed against Lapid’s plan with the Supreme Court since Lapid’s plan includes ousting the yeshiva and expropriating the land as part of the tziyun’s expansion. There are other reports that land owners of the tziyun area plan to follow with their own petition to the court in the hope of blocking Lapid’s plan.
In its petition, the yeshiva questions how the government feels it can oust a legal entity which has been in its current location for decades. The petition adds the expropriation would deliver a serious blow along with immeasurably compromise property rights, freedom of occupation and the rights to settle in line with the Basic Law guaranteeing Human Dignity and Liberty. The petition adds if the state believes that additional structures are required, such structures can be erected on other adjacent areas to the site, rather than expropriate the yeshiva’s structure.
The petition accuses the Lapid plan as being an assault against the religious community.
