David Flores, the pervert that shot four Shomrim members in 2010, was cleared Wednesday morning of all serious charges. He was only found guilty of weapon possession.
David Flores, the than 35-year-old man was identified by Shomrim units on Sept. 4, 2011, as acting indecently in front of young children, pulled a gun as they closed in on him and shot several bullets. Avrohom Kaztow, Motty Pearl, Motty Brauner and Yoily Klein were injured.
His defense claimed that he started shooting in self defense, because members of a local patrol were pursuing him instead of officers of the NYPD, and he was scared for his life.
According to the Daily News Oren Yaniv, Jurors said that while they like the idea of community patrol, Shomrim members were way to aggressive in pursuing Flores. “They’re not cops,” a juror said of the Shomrim.
Yaniv tweeted, “I directly asked about anti Jewish biased and the response was it wasn’t an issue.”
Another juror said of verdict, according to Yaniv, “It can show the Shomrim in a bad light–that’s the one thing I feel bad about.”
Flores can get between five to fifteen years on the guns charge, and he has already served more than three awaiting trial.

Even without a “stand your ground” laws (cf the Zimmerman case in Florida), juries tend to be sympathetic of someone defending themselves. In fact, most juries will be sympathetic is someone shoots a plain clothes policeman who has identified himself as a policeman. The fact that Shomrim was attempting to use physical force allows a person, even a criminal, to defend himself. It would be advisable if groups such as Shomrim were to simply phone the police and not try to apprehend suspects. In this case a photograph of him engaged in the crime and a quick phone call to the police were in order.
The judicial court in the U.S. is quickly becoming a top Sodomite court. Makes me sick to see murderers released while Shalom Mordechai ben Rivka Rubashkin is still behind bars for 27 years for nothing – just because he’s a religious Jew.
#2, you hit the nail on the head. Unfortunately, this just undermines the great work that Shomrim does.
He may not have gotten his due justice down here, but the ultimate Judge awaits him. Let’s not forget that.

#2 – your thought is not worth much. Waste of time to compare federal and state cases. Totally different sentencing guidelines.
It’s a tough test, all right, when one is witnessing a crime, and not to get involved. However, as a 19-year member of a very successful neighborhood watch patrol (with more than half those years as a watch commander), I can say with experience that the absolute best thing to do is to stay in your car, call the police, and let them handle it. Every new member of my patrol learns right up front: “If you get out of your car, you are expelled from the patrol!”
We all want to be kanaim, but in USA ’13, it’s not the way.
If he molests children will he be convicted then?? How many times does he have to be arrested for indecent exposure for him to rot there??
According to the Daily News, the perp is facing a sentence of 5 to 15 years. That is major.
As for the jury’s buying the self-defense argument, I guess that is about as reasonable as the police department’s view of young black and brown men who nearly all get stopped and frisked. I guess, to this jury, Shomrim look like they are up to no good. I don’t like that view, but some people in this city blame Shomrim and their supporters for all their troubles. Call it Shomrim profiling.
The boro park shomrim was doing a great job 10 years ago and just like everything is getting older and gets board the same to tham they don’t do anything today in these days. today we have another patrol already SHMIRA they are doing much more than shomrim in these days. Don’t get me wrong, I love shomrim and I don’t have nothing against tham but there not doing anything anymore!!!!!!!!!!!!!!!
