Charges Upgraded to Gang Assault for Undercover NYPD Cop in Biker Beating

suProsecutors say an undercover police detective was an active participant in a motorcycle rally that descended into violence in New York City.

Wojciech Braszczok appeared in court Wednesday and was charged with gang assault. He is expected to post the $150,000 bond set by the judge.

His attorney, John Arlia, says a video shows Braszczok was at least 12 feet away when an SUV driver was attacked.

The prosecution says the video shows Braszczok shattering the SUV’s rear window, then kicking the passenger side while a 2-year-old sat in the back Sept. 29.

The defense says there already was a hole in the vehicle’s back window.
