Court Orders Removal of Bnei Brak Shabbos Generators


bneibAs a result of a decision handed down by the Tel Aviv District Court, Bnei Brak City Hall will have to remove a Shabbos generators located in the Givat HaBanim area of the city. Neighborhood residents opposed to the generator petition the court in the hope of compelling its removal.

Justice Dr. Daphne Anviele ruled City Hall will have to remove the Shabbos generators permitting the city to supply residents in line with the stringencies of the Chazon Ish.

Addressing the court, residents explained the generators make too much noise and to the best of their knowledge, they were placed in the area without authorization, hence they feel they are pirate generators. The court pointed out that a ruling was issued five years ago and the city is guilty of contempt of court for ignoring the previous ruling.

Attorney Ariel Unger, who represented City Hall, told the court it was ignoring the need for the generators and the city’s residents seeking kosher Shabbos electricity. Unger added the city has been working to obtain the necessary permits while looking for an alternate site towards minimizing the suffering of area residents as a result of the noise and odor emitted from the generators.

The court rejected the city’s claims vigorously and spoke of a desire to avoid taking action against the city. The court added “It is expected that a public authority will respect the court’s ruling and set an example.” In addition, the court ordered City Hall to pay the petitioners’ court costs, amounting to 50,000 NIS.

Kikar Shabbos reports that the residents who took the city to court are chareidim as well, not secular residents.

  1. If you a nice modern orthodox who does everything the government says, no problem. But if you want to follow halachic interpretations that the government doesn’t endorse, be prepared for for persecution. By questioning the zionist state religion, you are a heretic and a traitor. And in a country that was founded on the belief in “freedom from religion” and barely tolerates the state religion based on a watered down version of religious zionism (leaving out the frum parts and focusing on the cultural and national parts) – that means it is public policy to persecute you. The zionists are telling the hareidim that maybe they should move to another country since frum Jews are not welcome in Eretz Yisrael (well, the Muslims might tolerate them if they respect Islamic supremacy, but that’s only a “might”).

  2. Are these generators noisier than those mosques loudspeakers in the middle of the night every night?
    The Arabs are not charedim so there’s no problem.
