HaGaon HaRav Chaim Kanievsky Shlita appointed three dayanim to probe the controversial construction in Beit Shemesh Binyan Shalem homes. The Gadol Hador met with the contractor, Reb Aryeh Golovnititz, who was recently attacked by thugs from Meah Shearim who oppose the project, and feel the construction is compromising Jewish kevarim.
However, Eida Chareidis Ravaad HaGaon HaRav Moshe Sternbuch Shlita has set forth regulations to permit continued construction and most of the families who bought apartments decided in a recently-held kenos to abide by the posek’s rulings.
It is now being reported that askanim affiliated with Asra Kadisha visited the home of Rav Chaim, seeking his support for their position. They explained permitting the construction will result in chilul kevarim.
In a directly related matter, Kikar Shabbos reported on Tuesday, 7 Elul that when approached in recent days regarding the construction project, Eida Gavaad HaGaon HaRav Yitzchok Tuvia Weiss Shlita commented he will no longer be involved in the matter.
Present were Rabbi Yisrael Yitzchok Kalmonovitz, a leader of Asra Kadisha, along with Dayanim Rabbi Mendel Lubin and Rabbi Yisrael Marmurosh, both members of the beis din of HaGaon HaRav Nissim Karelitz Shlita.
After hearing the sugya in dept Rav Chaim decided that Rabbi Shmuel Halprin and the two dayanim will consult with experts on kevarim and they will render a psak Halacha.

This is for poskim (who don’t have money interests) to decide. There are poskim to both sides, and there is no place for every shmoe to decide.
This story leaves out (at least) two important points:
1) That excavation work at the site has been halted until a decision is reached.
2) That the dayanim appointed by R’ Chaim, shlita, aren’t just “consulting with experts” but are to inspect the site personally and report back to him.
I was always taught that “rabbi shopping” is something one should not do.

bklynmom…. It’s a disgrace . This morning in BP, 13th Ave. cor. 52 st. , bundles of small flyers were strewn on the street lambastng Rav Sternbuch, not titling him with RAV, saying foul things about him in Yiddish and Hebrew, etc. Of course , they weren’t signed by whoever is doing it and nobody took responsibility for illegally dumping this shmutz all over the street.. They insult and create a chillul Hashem and call it Torah, then they dare call other Jews Amalek.
