OU Critiques Federal Court Ruling in Jerusalem Passport Case


ouToday, the Union of Orthodox Jewish Congregations of America, the nation’s largest Orthodox Jewish umbrella organization, critiqued the ruling of a federal court which upheld the State Department’s refusal to list “Israel” as the country of birth for Americans born in Jerusalem on their United States passports.

The decision by the United States Court of Appeals for the District of Columbia found that Congress, in passing a 2002 law mandating the listing of “Israel” should Americans born in Jerusalem request it, impinged on the Executive branch’s foreign policy prerogative, stating the request to list Israel “runs headlong into a carefully calibrated and longstanding Executive branch policy of neutrality toward Jerusalem.”

Nathan Diament, executive director of public policy for the Orthodox Union, issued the following statement in connection with the ruling:

“The Orthodox Union has long advocated for the principle that the holy city of Jerusalem is the eternal and indivisible capital of the State of Israel and the Jewish People. In this case, this principle is buttressed by the factual reality that Israel has made the modern city of Jerusalem its political capital. This fact has been recognized again and again by the United States Congress and duly enacted laws, even as such recognition has been practically unrecognized by the Executive Branch. The practice of the State Department to refuse compliance with the law is wrong and we will support the appeal of this ruling to the U.S. Supreme Court.”

  1. The United States does not recognize Israel’s ownership of Jerusalem. Remember that Jerusalem was NOT in the original 1947 boundaries. Note that even West Jerusalem is not recognized as part of Israel. That means the pre-1967 boundaries are NOT recognized by the USA, only the 1947 partition plan boundaries.

    If the same boycotts not affecting the West Bank are extended to everyone not in the 1947 boundaries, that would include Jaffa, Ashdod, Beersheva and much of the Galil.

    The Israelis would be wise to demand that the US and EU recognize the pre-1967 boundaries as a precondition for negotiations – since as long as the Americans and others don’t recognize West Jerusalem as Israeli, it means they haven’t even accepted the 1949 “green line”.

    Real people couldn’t care less whether their U.S. Passport says simply “Jerusalem” or if it says “Jerusalem, Israel”.

    In fact, real frum people would rather see plain ‘ole Jerusalem without any reference to the zionist state.

  3. We must remember that non-Jews cannot be expected to understand the historical and hashkafic issues regarding religious attitudes towards Zionism. Non-Jews who are anti-Zionistic are really anti-semitic. It is said that the Satmar Rav zt”l declared this clearly.

    #1 you write that the Israelis would be wise to get the world to accept the 1967 ceasefire lines – do you even care that such borders would be indefensible and put millions of jewish lives at risk. Do you even have a concept in your heart that the Israelis are actually your jewish brothers who you have an obligation to love and protect? It seems that ahavas Yisrael in your sick mind only applies to charedim.

    I ask all the sonei Medinat Yisrael here: Would you prefer to have the Jews of Eretz Yisrael live under Hamas and Fatah? Because that is the alternative.

  7. Do you know that in many synagogues, the “rabbinate” refuses to say he mesheberach for Medinat Yisrael but only the one for Hayaleh Yisrael.(Israei Soldiers).
