High Court Rejects Challenge To NY Gun Law

The justices on Monday declined to hear a challenge to a strict New York law that makes it difficult for residents to get a license to carry a concealed handgun in public.

The court did not comment in turning away an appeal from five state residents and the Second Amendment Foundation. Their lawsuit also drew support from the National Rifle Association and 20 states.

The high court action comes amid an intensifying congressional debate on new gun control measures. The issue has resurfaced prominently in Washington in the wake of the Newtown, Conn., school shooting that killed 20 children and six adults.

  1. The Second Amendment deals with the rights of citizens to be sufficiently armed to overthrown a tyrant (cf. England in 1688, American in 1776) – not take out a mugger. By that logic, modern infantry weapons (automatics with large clips) are protected, but small handguns aren’t.

    Then there is a public policy argument. While criminals prefer handguns, “nut jobs” do the most damage with assault rifles.

    One should remember that historically Jews did not have the right to bear arms, and one can argue that granting all free persons (excluding slaves) the right to bear arms was an extension of that right to religious minorities (note that in England at the time, they were uneasy in giving religious minorities the right to bear arms, based on their recent history of religious civil wars).

  2. 1. ANY weapon used against someone else outside of the context of “self-defense” is by definition an “assault” weapon.

    Liberals, as is normally the case, want to punish the law abiding citizens because of their inability to deal with those who break the law.

  3. I personally can’t understand why there are some who are so in love with & enamored by guns. If you want to own one, it’s fine by me, but why so obsessed?
    Having universal background checks in no way infringes on law abiding citizens owning a gun, the public is overwhelmingly in favor of this.
