Jerusalem: Recalcitrant Husband Flees Police Via Courthouse Bathroom Window


aRecalcitrant husband Shai Cohen made the news in Israel on Wednesday 24 Adar 5773 when he gave police the slip after being escorted to a hearing in the Rabbinical Court. When they arrived at the courthouse escorted by police of the Nachshon unit, Cohen asked if he could use the rest room and he climbed out of a window and fled.

The 40-year-old Holon resident evaded police, leading to a search of the downtown Jerusalem area. He has been in custody since October 2007 for his refusal to give his wife a get.

At the time of this report, the search for the escaped prisoner continues.

  1. Does Shai Cohen receive visitation with his children?

    If not, unfortunately, the Get is often the only resort available to a father.

  2. Although I have no pity on men that refuses to give a wife a get(unless of course she’s using extortions (which is usually the other way around)), I’m kind of surprised to find that they can throw a person in jail for refusing to give a get. Is there something I’m not getting hear?

    (May Hashem have rachamim on the poor wife.)

  3. Is there a policy of the government courts to try to look ridiculous?

    Why would so prefer to go to jail for six rather than give a “get”? It obviously isn’t over money at this point. This seems less of a case that requires formal legal proceedings, and more of one that someone requires informal mediation and conciliation – which the formal structure of the the Israeli court system (or any government court system) is not set up to provide. A traditional Beis Din, even in countries where they were recognized by the government, could easily switch out of the formal “court” mode in order to resolve a matter, since they were also charged with seeing to the good functioning of the community, unlike a governmental court system which is largely for resolving legal disputes but nothing more.
