NYS Judge Permits Lawsuit That Could Overturn Same-Gender Marriage


A state judge says a lawsuit seeking to overturn New York’s marriage equality act can move forward.

Acting State Supreme Court Justice Robert Wiggins ruled the State Senate may have violated the state’s open meeting law when discussing whether to bring the same-gender marriage bill to a vote.

Attorney General Eric Schneiderman said the meetings of the Republican caucus are exempt from the state law, even though guests were in attendance.

The judge also criticized Governor Andrew Cuomo for allowing legislators to vote on the act immediately after the bill was drafted, instead of waiting for three days, as is normally required.

The suit was filed by New Yorkers For Constitutional Freedoms, a conservative group.
