Ruling: Sholom Rubashkin Will Remain in Federal Custody


rubashkin5.gifCedar Rapids, Iowa: U.S. Magistrate Jon Scoles has ruled that Sholom Rubashkin should remain in federal custody after prosecutors argued he’s a flight risk.

The judge issued the order on Thursday, a day after a hearing was held. He was arrested last week on new charges, and had been released on $1 million bond.

Federal agents say that during a search of Rubashkin’s bedroom, they found about $20,000 in cash and silver coins packed with passports in a travel bag.

A trial hasn’t been set on the new charges.

Meanwhile, production of poultry was scheduled to resume on Thursday. YWN was unable to confirm if that indeed took place.

    Will they ch”v decide to hang him?! Then they could be sure he won’t be a flight risk. He also wouldn’t be a risk to tell the world what it’s like to be lynched in United States of America, by blood-thirsty animals who pose as “law-enforcement agents” and “animal-rights activists”.

    What will it take until there is a HUGE demonstration by every single man, woman and child from the entire frum Orthodox community demanding not to allow this minute-after-minute step-by-step destruction of a very vennerable and respected Jewish family.

    Have they inspected all the non-Jewish slaughterhouses throughout the country? WE DEMAND TO SEE THAT ALL OTHERS ARE “UP TO SNUFF”, BEFORE ALLOWING THEM TO ENGAGE IN A CAMPAIGN THAT IS DAMAGING, PAINFUL, TRAGIC, SELECTIVE OF THE JEWISH COMMUNITY.     while you seem certain that s. rubashkin is not a flight risk, the judge clearly saw things differently, especially considering the evidence cited. while you are “sure” that sholom wasn’t going anywhere, certainly reasonable minds could view this evidence differently. this is not communist russia and not a lynching. sholom will have his day in court.

    first of all, there will not be a “HUGE demonstration by every single man, woman and child from the entire frum Orthodox community”, because many people in the “frum Orthodox community” do not share your view that these proceedings constitute the “destruction of a very vennerable and respected Jewish family”. in fact, many in the “frum Orthodox community” feel that the ongoing saga of this case constitutes the largest scale chilull hashem perpetrated in HISTORY. this downward spiral has been going on for a very long time now, and many things could have been done (which were not) to address the problems and stop the chilul hashem. instead, time after time, each and every problem was met with defiance. perhaps you should have called for a “HUGE demonstration” against this chilul hashem. doing so a while back may have actually done rubashkin a lot of good, and sholom r. might not have been in sitting in jail right now if the frum community would have spoken out against him sooner. think about that! you claim to be a supporter of the rubashkins, but, in retrospect, your “support” and “encouragement” have only contributed to their sense of false security, and the defiant attitude which they approached their legal problems. perhaps had you related to them differently, you might have done them much more good, and saved them from going to jail. that would have been true ‘pidyon shevuyim’!!

    you suggest that we scream “KRISTALNACHT IN POSTVILLE!!” – how sick are you?? you insinuate that the rubashkin’s woes are tantamount to the holocaust?? you need your head examined. sholom rubashkin has been charged with several VERY serious crimes, and he will be afforded a fair trial in one of the most fair justice systems in the world (imperfect, yes, but still one of the best). he will receive glatt kosher food, be allowed to daven, have visitors, and other such accommodations while in prison. last i checked, jews in the holocaust weren’t given the opportunity to defend themselves in court, let alone given a hot glatt meal everyday. the fact that you could make such a comparison is offensive.

    perhaps if you take a break from your “daas torah” watch, you should study the story of r. amram at the end of kiddushin. r’ amram publicly embarrassed himself rather than cover up and hide an aveirah he was about to do, because “better to be embarrassed in this world than be embarrassed in the next world”.
    we in the frum community need to take some time to consider whether we should continue this systematic denial (as exhibited by #1 above) of every crime or wrongdoing involving another frum person, or should we learn to confront these issues publicly (since they are very public already). if we continue our pattern of denial, we only encourage and support additional wrongdoing, and we surely have a chelek in the continuing resulting chilul hashem. methinks that this will leave us with much to answer for in the next world.

    Unfortunately there are many from acheinu b’nei yisroel who continue to bash the Rubashkins, and naiively accept that if “THE AUTORITIES” got them they must be criminals. They talk the talk of “hevei dan l’chaf z’chus” but don’t at all walk the walk. I see a lot of their postings on this website, and kal-v’chomer on other sites.

    Klal yisroel must unite, and ALL rabbonim must speak in ALL shuls that every single yid must forcefully uproot the sinas chinom we allow ourselves to defaullt to, and rise up to defend this venerable family.

  6. While I cry at the though of his being in jail or prison, or at the thought of any Yid being in jail or prison, I hate to say it, but if I had been the judge, I would also have denied bail.

    He made the right move with the evidence presented to him.

    There is no sinah, there is no anti-semitism, there is just plain and simple consequences to behaviors.

    Yes, we need to daven for him and his family.
    Yes, we need to say Tehillin for him and his family.
    But, no, we should not go around blaming others for the fix he is in. It is not fair to blame the judge or the prosecutor for doing their jobs. All of the evidence points to his guilt and to his being a great flight risk. The judge had no choice in this matter.

    Hyperbole and sensationalism doesn’t help anyone — especially if it’s not true.

    You may not like PETA nor the Feds, and you may (as others) claim that selective and unfair prosecution is going on– but that may or may not be the case.

    There are too many “alleged” misdeeds here for a rational person to not assume that at least SOME of them are (unfortunately)true. I do agree with you that all slaughterhouses should be checked nationwide, and if it turns out that there has been unfair prosecution – it should be remedied.

    As far as the family goes, they may or may not be well respected and “chashuv” — this however has no relevance to the case of alleged misdeeds.

    Stealing from Reuven to give to Shimon is not being a Baal Chesed or Baal Tzedakah (as many people have referred to him). It is being a Baal Geneiva. One must pay their workers fair and agreed upon wages, and overtime– which was allegedly not done. Sorry to inform you of this.

    And not fullfilling one’s word to the familys who relocated to Pottsville from a foreign country? And Bank Fraud? Document Fraud?? All of these are untrue??

  8. D.T. Wtchdg & Yosi – What transpired today, as reported here, is a perfectly normal, conventional bail ruling. Evidence was offered showing probable plans to flee and bail was denied. No chiddush – happens probably hundreds of times a week in criminal courts.

The judge may have truly felt that there was a flight risk and it’s very possible that he’s right, but there is sina and his sina could only have helped him make that ruling, and if you want to know how I know that there is sina over here, the answer is that we are in גלות and the גיום hate us and especially and 100x more those of us who are successful and are wealthy.

    However, may I say that it is SO painful to read some of these comments. How can you have anything but the greatest rachmanus for a Jewish family who were turned overnight from riches to rags? Why give the benefit of the doubt to “The Justice System”, and not give the benefit of the doubt to other yiden who are in a dire situation and need it. In pre-war Germany also the yiden for centuries held the “hauchkorrekt” gov’t in the highest esteem, until they realized painfully what savage beasts they really were. Kudos & yasher koach to those professionals, but – why aren’t all the rabbonim screaming about this? (Guys – please don’t make my blood boil up by responding: “because they themselves are criminals!”) I wish there would be much more emphasis on that. Very unfortunately – it does not seem to be an important enough issue for the heads of some chashuva kehillos to address.
    Even if there were no halachic issurim involved, still since so many frum people have been jailed for a common-denominator of “white-collar” crimes, l’tovas hatzibur the rabbonim should rile against these sleazy practices that bring disaster onto many families, kehillos and klal yisroel at large.

    Now – what to do when the news – the EVIL, EVIL media – carry a story of a frum person caught doing no good? We then also have a halachic obligation – to give the individual the benfit of the doubt, and NOT BELIEVE IT! Do you hear what I say? You must NOT BELIEVE IT!!! That’s what the hielige Chafetz Chaim states many, many times in his flagship sefer. This should not be difficult if it’s the media & the “justice system”, who are not ‘cut from the finest cloth” (please see Avos 2:3).     – you insinuate that those who are not unconditionally supporting and encouraging the rubashkins (as you are) are guilty of “sinas chinam”.

    explain to me, then, the meaning of the mitzva of ‘hocheach tochiach’. we have an obligation to correct our fellow yiddin when they are doing things wrong. is this ‘sinah’, because we are not unquestioningly applauding every action they do?? chas v’shalom!! true ‘ahava’ is (constructively) confronting a fellow yid who is making a mistake, correcting him, and directing him on the right path. just like when we reprimand our own children when they misbehave, we do this out of love for them and their development as menchen, NOT out of ‘sinah’, chas ve’shalom.

    People such as D.T Watchdog should consider that when they spew forth rants, such as comparing this country to Germany, on a public forum without any fear of consequences – it puts a lie to those very rants. In anything but a free society someone in authority would silence them. I think they relish the paranoid world they create for themselves, and that no amount of logic or reasoning will move them from their ignorant intolerance.

  18. I can think of other cases off the top of my head where when a subject of an investigation (not Jewish) was found with a passport and large amount of cash, he was immediately deemed a flight risk and detained for that reason.

    I agree that 100% that all Yidden should have current passports and some amount of liquid assets readily available for their own safety, but that doesn’t mean that Mr. Rubashkin is somehow being singled out in being named a flight risk.

    Both my parents are holocaust survivors. Both recount how goyim who were friends of their family for generations OVENIGHT turned into their most vicious informers and murderers.     Hochayach tochicach is ONLY PRIVATELY, not in the form of a public website like this one. Otherwise, the passuk continues to say: “Vlo sisa alav chait”.

    Remember, the individual & his family DO read these postings, and writing tochacha on them about them is very hurtful to them, and not a mitzvah.

    As far as the Rubashkin family – it doesn’t seem that there’s any reason to worry that they will violate the law anytime in the future. As for therest of us, we should be admonished without mentioning the Rabashkin name or names of other yiden who were convicted of crimes.

Attorneys don’t go around wasting their time cooking up false cases like this . . . this is not 1908 Russia . . . and when they do overreach, the Federal Courts come down on them publicly. I work in a law enforcement agency (black hat, tzistzis out and all) and I don’t have the luxery of your erroneous judgments – you are clueless as to how the real world really works.

    First of all Yoni, how many times do you have to inform us that you work for law enforcement?
    I personally have no negious whether he rots or not. I don’t agree with those bloggers that this is Nazi Germany, but I do think this Judgement is based on anti-semitism. I looked up some news articles online on this case just now. He was arrested two times. The first time he was arrested, he was released on a large bail amt. besides which he had to wear an ankle bracelet and surrender his and his wife’s passports. Now I only found one article that stated whose passports they found this time. It was the kids, not his. Even YWN fails to mention this. It said in the article that the Court found three reasons not to release him this time – 1. The plant is up for sale -so it shows he wants to leave Iowa and there won’t be anymore ties for him to remain in Iowa. (False -it is up for sale because the Rubaskins are in serious financial trouble which was kicked off by the Federal raid.) (If somehow there financial woes are solved, the Rubashkins have no plans on leaving.) 2. He is a flight risk to Israel. (You know the gov’t always says that. Can you imagine the international uproar if every foreigner or immigrant accused of a crime would not be allowed to be released on bail because they might go back to their country of origin. Also, why do they always equate Jews with Israel? Do they equate every Catholic with Rome, Italy? Do they equate evey WASP with England?) 3. They found in his house a “travel” bag with his birth certificate, his kid’s passports and cash. (No one in The US of A besides people trying to run from the law would ever do such a thing.) Also, they know like I know, they can’t enter Israel without a passport. Also, someone who is being monitored 24/7 with GPS has about 5-10 minutes (at the most) to get away before they start chasing him. You can barely get around the block in that time, let alone leave Iowa or the Country. We should learn from the schvartzes, if they even suspect racism, they riot and burn to get their point across. This Judge either suffers from Delusional Paranoia or is an avid Anti-Semite!

    Bottom line,dont pass judgement,pleading guilty is no proof either,because they threaten you either plead guolty or we will throw the book at you.Rubashkin will plea rather than go to trial.It cost around 500k to run through a trial and you never know what way the jury will go.(o.j.etc.)

  24. We’re about to enter Shabbos. Let us ask Mechilah from each other for our strong words. There are many issues that have been raised, most of them valid for a forum. For example, has America been more vigorous in its prosecution of Jews than the general population? Do we frum Jews need to clean up our act? What do we who sit here at our computers need to do (aside from spellcheck and a few lessons in grammar)? Perhaps we should take a lesson from the Sotah.     You work in “law-enforcement”? Makes you even more sure of being a moser and rodeif. What do you do in your capacity as an “enforcer of the law” when you have to report or arrest a yid? Do you have any conflict within yourself? Does your conscience set off any alarms that, even if this yid has really committed a crime, your actions in bringing about his incrimination makes you a moser, hence CHAYAV MISAH?!     I say, it’s an individual’s decision to break the law and to teach and encourage his or her children to do it as well.

    NOT ALL frum yidden are sneaky crooks. But unfortunately many, many, many are. And unfortunately this type of illegal behavior has become acceptable behavior in our supposedly frum, pious communities. We frum yidden who are lawful unfortunately have to bear the brunt of all of you who are not.

  27. To corect an earlier and as yet unposted comment – there were at least tree sets of allegations brought against Rubashkin – State Labor, Federal Labor/Immigration and Federal Financial Fraud – both arrests were Federal, though on independent grounds brought by different grand juries.

  29. There are a few things that seem abnormal:

    1. Everyone writes how they found passports with the cash in his room. What they fail to mention is that he and his wife had allready given up their passports to the feds.

    2. The officers who searched his home and found the money, never actually counted it, they flipped through it and estimated how much there was. When the family counted it afterward, there was actually $12,000 – far from enough to run anywhere without a passport and with a family.

    3. The silver coins found, were the ones used for machtzis hashekel every year in Postville.

    4. His wife can only visit him once a week and even then cannot meet him face to face – only via video. Don’t forget he was never found guilty of anything, supposedly the only reason he is in prison is ascertain that he will not flee, so why the harsh treatment?!
