A New York state man seen in a video photographing papers on a desk in the U.S. Senate chamber during the Jan. 6 disturbance was freed on bail Friday after he was charged in the case.

Christopher Patrick Moynihan, 30, of Salt Point in Dutchess County was arrested Thursday and held until his appearance in White Plains federal court on Friday.

According to a criminal complaint, Moynihan can be heard saying: “There’s got to be something we can use against these (expletive) scumbags” as he rifles through Congressional papers, photographing some pages with his cell phone.

He was also seen standing on the dais inside the Senate chamber, according to the complaint.

An FBI agent said in the complaint that a former coworker of Moynihan identified him after seeing a video of the events at the Capitol last month.

His lawyer declined comment.

Moynihan was charged with trying to obstruct, influence and impede an official Congressional proceeding, entering a restricted government building or grounds, and uttering loud, threatening or abusive language on Capitol grounds with intent to disturb the orderly conduct of Congress.

He was scheduled to appear remotely at a hearing next week in Washington.
