    If you want some anti-daas torah, R’ Aaron Rakeffet has a bunch of shiurim on YUTorah where he lambasts daas torah. He says in one of them that R’ Soloveitchik said that we have to make an al chait for listening to the daas torah by the holocaust.

    I don’t think anybody will deny that it’s possible (maybe probable) that in general great Rabbis are smarter/have better insight. The issue is how this applies to individual issues that might be beyond the scope of Rabbinic expertise, or something in which they may not have all the information. The issue then becomes whether there can be a “psak” in non-halachic issues (unless you say that every issue is a halachic issue). In that regard see the Rambam peirush hamishnayos Sotah 3:5, Sanhedrin 10:3, Shavuos 1:4, Sefer Hamitzvos Lo Saaseh 133, Maamar Techias Hameisim, and R’ Shmuel Hanagid’s Mavo Hatalmud (the last line) for a start.

    The thing is that in this case, R’ Chaim was preceeded by the Chofetz Chaim who very clearly decried smoking, specifically because of the health issues. See Likutei Amarim perek 13 and Zechor L’Miriam perek 23.

    The Sefer Hachinuch is the only rishon that I know of (there could be rishonim that I haven’t seen) that extends Lo Tasur to every generation. The Chofetz Chaim in Sefer Hamitzvos Hakatzar quotes the Sefer Hachinuch. Even regarding the Sanhedrin itself, see the Torah Temima that if you think you are right you still have to listen, but if you are 100% sure that you are right than you don’t listen. He quotes the Ramban which seems to say that you do have to listen and he says that that is ??? ????? ???? ??? ??? and then reconciles the Ramban. There aren’t going to be too many mareh mekomos from Talmudic/Rishonic sources that are anything more than roundabout. In the past century or so there are several sources. See my forthcoming posts.

    Obviously the Maharsha would have no problem with someone who is medakdek in the sugyos and shittos when learning Sh”a. He never said that you shouldn’t learn it. His whole objection was that people learn it without being medakdek in the sugyos and shittos. So the fact that theoretically you could be medakdek does not address the Maharsha.

    He says it’s for kids and for chazara so that you will have all of halacha at your fingertips. That does not necessarily mean that it is meant to be a primary source.

    The term is used once in shas in Chulin 90b albeit in a different way then what it means now. Although it is a recent innovation, it definitely preceded R’ Moshe – you can begin seeing its usage circa the beginning of the 1900s in certain Rabbinical writings (e.g. R’ Elchanan Wasserman) and Agudas Yisrael along with the Jewish Observer brought it to the masses.

    He does not say that. He says that it MIGHT be bal tosif. If it’s real techeiles then it for sure isn’t bal tosif. If it’s not real techeiles, then it shouldn’t be any different than doing any mitzvah with a cheftza that is safek kosher e.g. tefillin, esrog etc. R’ Shternbuch is MECHADESH a chiluk in order to say that techeiles is different. And even if theoretically bal tosif would be an issue, you can just make a tenai that if it’s not real techeiles then it’s not l’shem mitzvah (which R’ Shternbuch himself acknowledges).

    I’m not PASKENING from the Aruch Hashulchan. I’m just pointing out that having commentaries on the Shulchan Aruch doesn’t solve the problem.

    I’ll give an example where if you just read the Sh”a and Mishna Berura without background knowledge,you may end up with the wrong halacha: The Sh”a says (O.C. 9:5) that some say that the tzitzis have to be the same color as the begged. The Rema argues that Ashkenazim should only make white strings regardless of the color of the begged. The Mishna Berura brings down the suggestion of the acharonim that in order to avoid this machlokes one should only wear a white begged with white strings.

    Now let’s say that one is deciding whether to wear Techeiles or not. Someone who only learned the Sh”a and Mishna Berura will say (and I’ve heard many people say this) that on the chance that it’s not real techeiles, they will be wearing a white begged with blue strings, in violation of the Sh”a, the Rema, AND the Mishna Berura.

    However, if the person had started with the gemara, he would know that the gemara says that even kala ilan (fake techeiles) is no worse than white strings and therefore there would be no problem. AAAIII, the Sh”a says it is a problem! Well if this person would know even more gemara, he would know that the reason why the colors would have to be the same is because the strings have to be min knaf* which doesn’t apply to techeiles strings. While you won’t find this in the Sh”a/ Mishna Berura, you can find it in the Artzos Hachaim, the Chazon Ish, and other more obscure places that this person who learns Sh”a with Mishna Berura won’t see.

    *According to Tosafos the reason for the colors being the same is zeh keli veanveihu which would also clearly not apply to the techeiles strings which won’t be the same color as the begged even if it’s real techeiles. (There are those [the Smag as explained by the Chazon Ish, and presumably the Levush) who hold that when you don’t have techeiles, the strings that would have been techeiles take on the status of regular non-techeiles strings, but there’s no problem because they also hold that there is no inyan in the first place of having the colors be the same)

    People have been ignoring the calls of gedolim for as long as gedolim have been making calls. Regarding the (current) Roshei Yeshiva, perhaps they feel that kids these days can’t handle the original method of learning, or perhaps they don’t want to cause an uprising or any number of other reasons. Maybe it’s easier for the Roshei Yeshiva to give shiurim with this method.

    My point is that from what I see in my dealings with Orthodox Jews, their perception of the Shulchan Aruch does not fit with how the Gedolei HaAcharonim viewed it. I tried to be melamed zechus with the Pischei Teshuva but I brought the Aruch Hashulchan to disagree with the limud zechus. I brought the Mishna Berura as another limud zechus.

    While it is not my job to justify why people don’t follow the Roshei Hayshiva, I would venture to postulate that there is simple reason: The style of Iyun is enjoyable – klerring chakiros and zugging chiddushim. It is stimulating and does not particularly require being ???? ????. Whereas gaining and retaining broad knowledge of shas is tedious, hard, repetitive, and requires extreme diligence. It is therefore much easier and geshmak to learn Iyun.

    There is a story in the biography of R’ Baruch Ber in which as a young child he asked a question in shiur which the Gemara later in that masechta addresses. The Rebbe berated him for asking a question that was a befairush gemara. R’ Baruch Ber went home and cried and took upon himself to not go back to shiur until he had learned all of Shas, which he then did.
