Patur Aval AssurParticipantMy assessment of the responses to my question:
Several people agreed with me. Several people took this as an opportunity to get in another pointless (as per my first post) ideological debate. Nobody answered the question except for the one suggestion about kiddushin, which in fact doesn’t answer the question; it simply points out a potential halachic nafka minah of whether the State is the beginning of the redemption.

Allow me to modify your scenario slightly in order to isolate the issue under discussion. We have a guy who learns before Shacharis and after Maariv. The financial situation of the family is such that between Shacharis and Maariv he will not be learning. There are also things that need to be taken care of at home (e.g. taking care of the kids, cooking, cleaning etc.) which will take up the time between Shacharis and Maariv. Now there are two parents in this family and there are two jobs which need to get done during the same period of time (i.e. only one person can do each job) – the job in the workplace and the job in the house. Now let’s say that the husband is better at cooking and cleaning and taking care of children, and the wife is better at making money. Well according to the Fifth Principle of Economics, the productive way to run this household would be for the woman to go out and work and the man take care of the home. Is there anything wrong with this picture?
Furthermore, much of what is conceived of as men’s roles or women’s roles, is based on men in general being more _____ and women in general being more _____. Now everyone knows that in general men are taller than women and have more muscle mass then women. So obviously, if a married couple needed to get something done which involved height or strength, the husband should be the one to do it, right? But what if the wife is taller or stronger? Should it still be the husband’s job to do it simply because in general, men are taller or stronger than women?
Similarly, it may well be that women are generally better at cooking, cleaning, and childrearing, and are more emotional and empathetic and many other things. But that doesn’t mean that any given man can’t be better at those things and have more of those traits than any given woman. So why shouldn’t the husband do the cooking if he’s better at it and enjoys it more?
All this was just to show that there is no such thing as an inherent role. However, there are some exceptions. Some roles are Divinely dictated, e.g. a man has to do Time-Bound Positive Commandments, and some roles are physiologically dictated, e.g. women giving birth (at least for now). But on anything else, why should we create artificial limitations?
Patur Aval AssurParticipantMy point is why does anyone have to commit to being a zionist or an anti-zionist? Each issue can be judged on its own merit without the need for an ideological split.

Now I think we are both very confused about the whole sarcasticon reference, so let me just spell it all out. In the thread “Sem and Security”, I was having a debate/discussion with writersoul in which at one point she said that she obviously agrees with me. I responded by saying: “I’m glad I’m so convincing that you would OBVIOUSLY agree with me. (I wish I could properly convey sarcasm in writing. I refuse on principle to use those smiley faces.)” Then the discussion sort of became about emoticons. So when I said over here “insert sarcasticon if desired” it was a reference to the fact that I wouldn’t put emoticons in my writing.

Patur Aval AssurParticipantThe only thing you see from that Gemara is that the Rabbanan don’t need physical protection since their Torah protects them. It seems that the Torah does not protect anyone else. And it also seems that the Rabbanan would be protected even if no physical measures were taken, for otherwise
???? ?? ????? ??????? would not really be true. (Perhaps one could argue that they don’t need protection, but they do need there to be a physical protection in order for their Torah protection not to be miraculous, but then in essence they need the physical protection just as much as the rest of the city, albeit for a different reason.) A possible ramification would be that the Rabbanan should not be allowed to use any of the physical resources.

But regardless of when it was confiscated, none of them would have any reason to assume that it wasn’t still on the school premises. In fact I think it’s actually a kashya on Lupin. After the first time that Sirius entered the castle, he should have immediately sought the map. A simple summoning charm could have gotten it for him. Which incidentally leads me to my next question: Fred and George’s entire plan of escape in the fifth book relied on summoning their brooms. What would have happened had Umbridge protected the brooms from summoning charms? But perhaps Fred and George had somehow determined that she hadn’t.

October 26, 2014 8:14 pm at 8:14 pm in reply to: Dr. Randomex's first official Coffee Room studio (recording in progress) #1038631Patur Aval AssurParticipantPatur Aval Assur – Unknown, but not a mouth instrument. He feels that specifying his instrument would be giving away “too much personal information.”
All I said there was that I was playing an instrument while reading a magazine, that I was playing an instrument while attempting to recite “The Road Not Taken”, and that I was playing an instrument while attempting to mentally recite “The Road Not Taken”. Presumably you are assuming that in order for me to be capable of talking the instrument could not have been a mouth instrument. A fair assumption, but only one out of my three incidents involved talking.
Patur Aval AssurParticipantDaasYochid:
I think you misunderstood my kashya. The kashya is that the Gemara says that the Rabbanan are patur because they do not need protection. Apparently, the rest of the city which is not patur, does need protection, despite the Torah learning of the Rabbanan. Had the Gemara said that the Rabbanan and the laymen are equally protected and the Rabbanan are patur because they are contributing to the city’s protection in a different way, then it would be a different story.
As to the rest of your response, do you think that if R’ Moshe thought that there was a grave spiritual danger, he would unqualifyingly write that army service is an inyan gadol? I highly doubt it, and anyway he should have told them that it is assur to go the army instead of just telling them that Yeshiva is better. Since when does R’ Moshe only mention one of two reasons for something in his teshuvos, especially when not mentioning the second one is quite misleading. Let’s say for example that these two guys one day became physically incapable of learning for whatever reason. Well according to you, what would come out is that these guys would join the army based on R’ Moshe’s teshuva, when in fact R’ Moshe would hold that it’s assur to join the army. I don’t see how it is could be that R’ Moshe held that something is assur yet simply wrote that it is an inyan gadol. I guess there’s always the possibility that he was pandering to them and didn’t intend to publish this teshuva for the general populace, and it was post-humously published.
October 26, 2014 7:25 pm at 7:25 pm in reply to: NeutiquamErro's favorite thread with an obscure title #1147508Patur Aval AssurParticipantI don’t think it’s so crazy that Harry never noticed Sirius or Peter. First of all, he didn’t exactly use the map very often. And when he was using the map, Sirius may have been out of the maps boundaries. Peter was probably either with Ron or chilling in the dormitory, which are not exactly places that Harry would be wont to look at, and during the periods when he was missing, he may have also been outside the boundaries.
It is interesting though, because Peter and Sirius both knew about the map and Peter for sure knew that Lupin was in Hogwarts, so they may have had some fear of being seen. This in turn may have led them to be careful to whatever extent possible to not be seen on the map.
Patur Aval AssurParticipantDaasYochid:
Let me preface my remarks by stating that I am not offering a position on the issue of army service; I am discussing individual mekoros, at this particular moment, the teshuva of R’ Moshe.
I will start by isolating his individual points:
1) Army service is an inyan gadol.
2) Limud Hatorah is better as we see in Bava Basra.
3) The government recognizes this and grants exemptions to those who are learning.
4) Therefore, one who has a passion for learning Torah and to become a gadol in Torah, Hora’ah, and yiras shamayim should go to Yeshiva.
First of all, (and this part is really just stam a kashye on the teshuva, not relevant to what you said) how does the Gemara show that learning is better? All the Gemara says is that the Rabbanan are patur. If anything the Gemara should indicate the oppoisite, because if learning was better (for protective purposes, which is what R’ Moshe seems to be saying) then the entire city should be patur. (You can perhaps give some answer involving hishtadlus, but I’ll leave that up to you.)
His only other point in support of staying in Yeshiva is that the government is maskim. Obviously, then if the government is no longer maskim then this point would cease to be relevant. In such a scenario, all we have left is that Torah is better than Army Service. Now here is where the metzius would be relevant. It is eminently conceivable that a point can be reached where despite Torah being better than army service, the psak could be to to gather arms. I think many people would say that if there was an armed bad guy in the Yeshiva, one should stop learning in order to shot him. (That is an extreme example, intended to illustrate a point.) At this point, it can become very relevant whether the army is spiritually dangerous, as that might override the concerns that are advocating for army service. Therefore it would be instructive for R’ Moshe to discuss it.
October 26, 2014 6:50 pm at 6:50 pm in reply to: NeutiquamErro's favorite thread with an obscure title #1147506Patur Aval AssurParticipantGryffindorable Girl:
That would affect at least several years before Harry’s year as well. Remember, Mr. and Mrs, Weasely quickly got married because no one was certain about the future with Voldemort and all. Bill finished Hogwarts before Harry started, so this would certainly apply to anyone who overlapped with Harry.
Patur Aval AssurParticipantOk. Once this thread got somewhat distracted by the eternal Zionism debate:
Why is Zionism such a hot topic of debate? The State of Israel already exists, and there doesn’t seem like there is much we can do about that. (And I think that most Anti-Zionists don’t advocate for destroying the State.) It’s pretty obvious that the State does good things and bad things. On any given issue related to Israel, every posek/important Rabbi/whatever you want to call them should formulate an opinion in much the same way as they do in any other area. If the question is whether or not to serve in the army, then the issues to be determined are whether it is a milchemet mitzvah, whether it is pikuach nefesh (both physically and spiritually) in either direction, whether it is unacceptable bittul torah etc. Conceivably, one can hold that one is obligated to serve in the army on the basis of ????? ????? ??? ?? ??? ????? (Hilchos Melachim 5:1) yet still be an anti-zionist. Similarly, one can be a fervent zionist and still hold not to say Hallel on Yom Ha’atzmaut because that is his/her conclusion in the sugya of Hallel. The various positions on the contemporary mitzvah of living in Israel also should be irrelevant to Zionism. The only real difference that I see, is the extent of focus on Israel/the State of Israel, which hardly seems like something worthy of such devisiveness.
October 26, 2014 6:14 pm at 6:14 pm in reply to: Why Can't Women Get Modern Smicha and Become Rabbis? #1071730Patur Aval AssurParticipantI will address your four paragraphs, one at a time:
1) You seem to be agreeing that there is nothing wrong with a woman answering halachic questions (assuming she is capable). This accords with some sources which I quoted earlier in this thread. Your objection seems to be that Torah-study necessary to enable a woman to answer these questions is the problem. Now I will grant that men have a chiyuv to learn which women don’t have. But how does that make it an anti-women role? It just means that it is not her primary purpose. But there are many things which are not a woman’s primary purpose, which they can do anyway. And who says that peoples roles have to remain utterly stagnant over the course of thousands of years? Presumably people’s roles have changed somewhat as we moved from a nomadic society to an agricultural society and from an agricultural society to an industrial society. You did not bring up the argument about women inherently being unable to learn (e.g. da’atan kalos, tiflus) so I won’t address that.
2) The objections in this paragraph have nothing to do with what I am discussing. But just for the sake of arguing, your tznius objection does not pertain to being a Rabbi; it is simply an objection to any public role for women (in the presence of men).
3) The people they came out against, had a clear agenda. I am not pushing that agenda. Additionally, I would like to see the reasoning behind the statements. Other than it being simply a policy issue, I have not seen any reason why what I am saying cannot be done.
See also, the Peri Megadim in Seder V’hanhagos Hanishal Im Hashoel B’issur V’hetter ose 10 where he writes: ????? ?? ???? ???? ???? ????? ????? ??? ???? ?? ????? ???
4) There are a lot of undefined pronouns there.

That’s another issue. There are five boys in Harry’s year in his house. If that is representative of the school at large then the total number of students should be something like 5x2x7x4 which would come out to 210 students.

Patur Aval AssurParticipantcozimjewish:
Maybe that will be my next project after the one I am undertaking in my report card thread. But it might be too hard, because in this story, the sources for my ideas were much less direct than in the previous story, so providing citations might no really help. But we shall see.
Patur Aval AssurParticipantLetakein Girl:
I actually realized that I left you out, very soon after posting it. My sincerest apologies.

“My mouth is hanging open. Like this: 0.”

Indeed it is, and I don’t object to those who wish to insult me. But I didn’t think I did something that would be characterized as “shrewd nastiness”, so I wanted to clarify.

If you want I will post all the comments in one list with citations so you can read them in context.
Were you serious about the “shrewd nastiness”?

Oh, I wasn’t saying that you didn’t mean it in a nice way; I was saying that it is not inherently complimentary.
Patur Aval AssurParticipant“PAA wow you make me sound sooo ambitious”

I hope you didn’t take it personally.
October 26, 2014 1:13 am at 1:13 am in reply to: Paskening Hashkafa: Academic vs. Practical Rationales #1042245Patur Aval AssurParticipant“No, because they all offer an explanation consistent with the Rambam.”
Except none of them authored Machnisei Rachamim, nor did any of them author the Yesod Hachamishi, so it is conjecture (which doesn’t necessarily make it wrong) or perhaps reverse engineering.
