“Say a boat with all strangers is sinking that you have nothing to do with or even know who anyone is, for example. Or any situation where between two people you have nothing other than the kedima stated in halacha.”

There has not been a case in the past 100 years I am aware of where a man was saved over a woman and the woman was left to drown or a yisroel was saved before a convert because of any halacha. Not one case. If there has been a case please tell me I would sincerely like to know.

Well obviously not from what I quoted earlier and also I remember Rav Eliezer Waldenberg saying it does not apply to saving- many Rabbis dont hold by that today. Rav Moshe would also consider many people today who are kohanim not to be because he requires more proof than most poskim. Rov Moshe also says its only when all else is equal which we could never know. So one way or another halacha has adapted not to follow this order lemeisa.

I would challenge you to tell me one real-life case this has actually happened where a man was saved before a woman because of this. It has been relegated into the impossible and non-practical.

It is NEVER followed in real life. Does hatzola follow this order? Do doctors? Do frum firemen? No one follows this lemeisa.

“Safek Kohanim? That doesn’t make any sense. I mean, it does, but no one since the before the Chasam Sofer and R’ Akiva Eiger have held that Kohanim were actually Safek Kohanim. We assume our Kohanim are real Kohanim and that a Ksav Yichus is just a Chumra by doing the Avodah. Otherwise we wouldn’t do Pidyon HaBen.”

I asked my rov a while ago he told me since they are only safek it does not warrant saving a life. I got an email from another Rabbi saying the same thing. I asked another rov about giving a kohen kedima in tzedaka and he told me not to so as well. The email gave me these sources: See “Shulchan Aruch” Y.D. 251:9 and “Aruch HaShulchan” 11 there. R’ Tam on Taz 128:39 and others i can look back at the email if you want

Yes, I asked a posek if a Kohen should be saved before a Yisroel and he said a Kohen is not saved first because they are only safek kohanim. I believe we have already had this talk. And for women, it only applies when everything else is exactly equal. And things are never exactly equal. So its not lemeisa. The poskim will find a way out of these things.

Joseph, can we put an end to this once and for all: did you actually ask a question what to do lemeisa to a Posek and he told me lemeisa to save a man before a woman? And he told you lemeisa to save a kohen before a levi?

“No serious rosh yeshiva ever said we stop following a halacha in Shulchan Aruch in our days or that we shouldn’t talk about a mishna.”

Yes, I asked if a Kohen should be saved before a Yisroel and he said a Kohen is not saved first because they are only safek kohanim. I believe we have already had this talk. And for women, it only applies when everything else is exactly equal. And things are never exactly equal. So its not lemeisa. The poskim will find a way out of these things.

And yes, a serious Roshe Yeshiva has told me halacha like these will make people on the fence go off the derech and we should not talk about them to certain people. For privacy reasons I dont want to say his name. Of course, you have the right to disagree and I personally disagree with any sort of censorship.

Joseph, in my humble opinion, I dont think the motive for you asking these questions is coming from your neshama, I think its coming from your yetzer hara.

I will tell you I have heard a roshe yeshiva, one of the most respected, say not to bring up this mishna as it will cause people to go off the derech. The priority structure for saving is not followed today lemeisa by anyone. Also, halacha sometimes has to be very simplistic and it can be misconstrued so people who dont know how halacha works might think the hierarchy is indicative of some sort of superiority.

Two male witnesses are believed for instance who we dont know anything about, but one witness is not believed even if its Rov Moshe Feinstein. Does that make the two witnesses “superior” to Rov Moshe Feinstein? Certainly not. But thats how halacha works, its often simplistic.

Halacha also allows for slavery. It allows the slave owner to breed their slaves. It allows to stone people to death and calls for mass genocide. Why dont you talk about those halachos?

    Avi: Thats an interesting point.

If we use our common sense, throughout the thousands of years of people being forced to convert, inter-marriage, willingly converting, being put up for adoption, simply going off the derech for whatever reason etc. In every country there are an untold number of Jewish neshamos out there. Its common sense.

I always hated this kedima structure because I am a gizbar, so if I get stuck on a sinking ship with an amarkal I am basically a dead man. Also, for a mother, I believe she takes precedence of your own life as well.

“Well, no offense of course but that tree thing was your doing.”

I dont see why other people calling me a tree and someone else changing my subtitle without me knowing about it was my doing because I started a thread. It was obviously not a thread to be taken literally but to make a point. Poetry is not literal either. Some people I know are into Judaism only for the ethnic aspect and view Jews almost like a genetic race. Thats the point I was trying to make. The meaningful part of being Jewish is actually keeping the Torah, not that you are “genetically” Jewish.

Sam: I did not say its not relevant in every context. I said its not meaningful to me.

“Becasue it is counter factual and illogical.

The thing that bother me is that you dont even respond to questions.”

I dont think its counter factual and illogical at all. So half of modern Spain having Jewish neshamos is fine with you but a large percentage of other countries also is so illogical? Over a period of thousands of years I dont think its illogical at all.

Regarding responding to every question, I dont have time to address every nuance. I made a basic point and other people reading the thread can decide for themselves who they agree with. You can make a counter point, thats up to you.

“why you dont consider halachicly Jewsih “meaningful”? whether you can eat Bernie Sander’s Chametz after PEsach? Wether you can eat a Goy’s Chametz after PEsach? If Amira L’akum can ever be utilized? differences between Sander’s and other sregarding conversion, MArriage etc etc etc.”

Im not sure what to say, I just dont find these things meaningful. I dont put a big emphasis on raising the meaning of one person above another based on who their mother is when their actions and beliefs are so contrary to the Torah.

Regarding other people in other countries having a Jewish neshama, I stand by that I think it is very likely that many do. I am not sure why that would bother you or others.

Like I said, in some cases halacha considers him to be like a goy in some cases it doesn’t. Apikorsim are viewed very harshly.

The fact that her kids wont have to convert or I cant use him on shabbos? I dont consider these things meaningful when it comes to hanging his picture up on my wall- no.

DaasYochid: There are places in halacha were a “Jew” like Bernie Sanders is treated like a goy and other times he is treated like a Jew keneged halacha. Who cares? He blatantly doesn’t believe in Hashem or keep any of the Torah- hence he is not a Jew in any meaningful way.

He thinks the Torah is outdated and silly.

Use your common sense. He is not Jewish in any meaningful way. This is not a halachic conversation. I dont really debate halacha on this site, for that I talk to my rov.

“Avram: Sure. Incest is one example. Also, a purported non-Jew may have sinned with an eishes ish who did have an earlier halachic marriage that never terminated and generations later none of the decedents were aware of their Jewish lineage.”

Thats a good example. But im talking about people having Jewish neshamos, there are millions of people that have Jewish neshamos Im sure. There is a good chance there has been a presidential candidate with a Jewish neshama. So Im not going to post Einstein photos on my wall and brag how he was a Jew- it means nothing to me.

The fact is, there are most likely millions of jewish neshamos out there we dont know about. So I dont have a special kinship with bernie sanders or albert einstiein because they are/were halachically Jewish.

Who cares about amira l’akum with regards to this discussion? Ha yea, I will charge interest to a non-Jew and Bernie Sanders alike. When Bernie takes my money away Im going to demand it back with interest just like I would charge interest to any non-Jew. Just like a goy, I would never allow Bernie Sanders to daven for the amud either. Because he is not Jewish in any meaningful way.

“the difference is that one is halachically Jewish because his mother is, and the other is not halachically presumed to be Jewish, despite the remote possibility that he technically is.”

I would not call the possibility as remote as you would. But when choosing a presidential candidate out of a sense of Jewish pride or what have you- there is no significant difference. Some people say they will vote for Sanders because he has a Jewish neshama or out of a sence of Jewish solidarity or they want to see the first Jewish president. Im saying all these notions are silly to me. Generating feelings of kinship with apikorsim simply because they are famous and esteemed by the world is nonsense.

Thats right, I dont differentiate, I dont really care. I dont share more of a kinship with gefilta fish eaters than I do with millions of Americans presumed to be goyim that very well may be Jewish also.

Similarly, I dont take pride in the fact Einstein or Spinoza were technically Jewish. It means absolutely nothing to me, I dont get why some yeshiva schools hang up his picture likes its some sort of Jewish pride.

A lack of chazaka would not take away someones Jewish neshama (whatever that is worth) if they are truly Jewish. So there probably have been Jewish US presidents in the past. I dont care if he is techincally Jewish because someone being Jewish on a technical level while at the same time not keeping any mitzvos whatsoever and proclaims basically that God does not even exist means nothing to me.

I dont care if halacha considers him Jewish or not when he does not believe in God. Unlike other people who for some reason value the fact that he knows what matzha balls are and has tasted gefilta fish in his life. If anything, a Jewish neshama can lead to more bad than good when it is off the derech.

I would second that, only because most people will associate Sanders as being Jewish, when in fact he should not be considered Jewish simply because he is on a technical level. On a technical level, Im sure there have already been US presidents who are Jewish as well- we just don’t know they were Jewish.

My rov once said in shiur that huge portions of these countries are probably Jewish. Do you know where the 10 tribes went and over thousands of years how many hidden Jews there are?

There is no such thing as Jewish blood, since many people convert to Judaism as well and get Jewish neshamos and pass these neshamos to their descendants for all time. But there is ethnic Jewish dna which a majority of ashkenaz Jews share.

The point is almost every candidate can have a Jewish neshama, so dont vote for Sanders because he has a Jewish neshama.

Point is Jews should not vote for him because he has a “Jewish neshama”.

Most people who have Christmas trees are probably Jewish as well in many areas. Who cares if he is Jewish or not by that standard.

All of the other candidates might very likely have a Jewish neshama also. There is a good possibility Trump, Clinton, Rubio, Cruz are Jewish also.

I personally think its a very bad idea. “He treats his wife so much better” “She is more attractive” “He makes more money” “She makes more money” “They already have kids and they are so cute” “Why can they afford a 3 bedroom and we cant” etc. Its probably a great way to ruin your shabbos and get into fights unless you are clearly the couple society places a higher value on. Very often, the other couple is at the “top of their game” so the visiting couple or host do not even see what goes on behind the scenes.

But on the other hand people have a way of making friends with others who have the same type of income and status. If you dont, often you will not be invited in the first place. I still think the couple should have meals either at their own place, family or go to middle aged to elderly couples.

Its interesting why the question was not asked about older couples- I guess because couples in their 60s don’t care about these things anymore.
