    My point in saying that is to show that almost everything here I wrote about halacha is not pashut, it’s complicated. Just relying on what I wrote here is not a good idea.

    Oh, by the way, Rav Moshe clearly writes that Lev Darka Achrina can only be used for legitimate purposes in IM EH 1:56.

    DaasYochid- I never in this thread was defending watching dirty movies. I came here defending clean movies. If somebody is going to moreh heter to watch dirty movies, that is his fault. Dirty movies are assur.

    But, now I realize that clean movies might have problems, even without pritzus. So I came back here before Yom Kippur, to tell people so. I also made clear that any discussion in here was talking in learning. A lot of things that I wrote have kashas on them that you posted. A lot of things here are my own savara.

    So I am warning the public:

    DaasYochid- Can you ask you an honest question? Did it come out that I was paskening it was mutar to watch movies? I was just talking in learning.

    And no, GoGoGo is specifically talking about smoking.

    And even if someone was intending to pasken, paskening from the CR in the first place is not a good idea.

    One should ask a Rav before he decides to smoke. And if one is, unfortunately, already smoking he should speak to a Rav to see what action to take.

    I want to make clear, since it is before Yom Kippur, that nothing I wrote here was intended to pasken, and that anything I discussed was just talking in learning. As seen by the different kashas against me, most of what I said may not have a solid backing in the Poskim and if anybody relies on anything I said here is making a big mistake since I am not a posek nor anywhere close to being one (and even if I was, I was not intending to pasken.)

    Besides, there could be other issues with movies besides pritzus that was not enumerated.

    PS There are reports that Rav Reuven Feinstein shlit”a holds that had his father been alive now, he would have assered. One should be very wary before being somech on Rav Moshe’s opinion that smoking is mutar under certain circumstances.

    Let’s say the OU signs some kind of contract with the dairy, saying if you put in non-kosher milk, you get a fine just like the fine that is given now by the FDA.

    Here’s my question:

    If we go acc. to the heter of Rav Moshe of “shelo byad yisrael”, what can a Yid do to make it chalav yisrael when it has already been milked but still in the non-Jew’s hand?

    Joseph-The OU is not involved in making sure the milk is from a cow, what they do is have yotzi vnichnas by the dairy to make sure the milk does not get unkosher ingredients (such as non-kosher vitamins) added in.

    But you actually bring up an excellent point, that I have not thought of before. If the OU is inspecting the dairy, then acc. to Rav Moshe tz”l, it could possibly suffice. Again, Rav Moshe holds the gezeriah only takes effect when it reaches the hand of a Jew (IM YD 1:49). Therefore while it is in the dairy, why can’t the OU’s yotzi vnichnas suffice to actually make it chalav yisrael without government inspection needed? Unless you say that the OU would have to be tomid at the dairy for this to work.

    DaasYochid- Thank You. Bli neder, I will try to do more research but I just want to make the point that acc. to Rav Moshe’s teshuvas it is very mashma that chemical testing is not needed.

    Don’t have time right now to look through the whole thing but saw some emails on the bottom. The Nirbater Rav shlit”a is showing that there are no chemical testing. But, again Rav Moshe tz”l never required chemical testing in the first place. The FDA is watching to make sure the milk is not adulterated. That is what is needed. I don’t really understand.

    Don’t really understand. Acc. to Rav Avrohom Gordimer, one of the top experts of this subject, the state makes unannounced visits to farms. If non-kosher animals are present, that would be a glaring violation.

    I don’t know why you are dismissing out of hand something which some serious talmidei chachomim hold to be a problem.

    I’m not. I just don’t understand why people would think the inspection has gotten worse acc. to Rav Moshe tz”l in more recent years.

    Rav Moshe said we needed inspectors by the dairies. There still is. The FDA does not need to know where the milk came from, it just needs to make sure no non-kosher milk is added in. This has not changed.

    What has changed, is that the farms are generally not connected to the dairies anymore. But instead there are now state inspectors directly at the farms.

    If you can give me a reason how the situation is worse than before, fine. Just quoting Rabbanim saying to be machmir, when it could be bec. of a myriad of different issues why they could say to be machmir (DA cows, the widespread available cholov yisrael, added ingredients such as vitamins) does not prove that inspection is worse than before.

    There is only one issue. I don’t exactly see how the situation became less to be somech on according to Rav Moshe tz”l besides the DA cow. Indeed, it has only gotten stronger on the inspection issue.

    Did he say why?

    It could be bec. of the DA cow issue, or maybe he held there needed to be a way for the inspectors to know at the dairy which species the milk came from.

    Acc. to Rav Moshe tz”l (except possibly the DA issue, but I heard that they asked this shayla to Rav Moshe while he was still alive), the heter is stronger than before.

    BTW, the OU calls it Chalav Stam. Also, in this article, they admit that it’s no longer R’ Moshe’s heter, but a different one (based on R’ Moshe’s heter). Not everyone agrees to it.

    This is a misconception. Rav Moshe always allowed milk from dairies even without regulation by the farms (See Igros Moshe YD 1:49 for the concept of “Shelo Ba Lyad Yisrael)

    Some say there used to be chemical testing by the dairy that was able to identify the species of the animal the milk came from. If that is true, that was never needed. Also, the dairies used to have on site farms, where the inspectors can see the animals themselves.

    That is what has basically changed. The daires are generally not connected to the farms, but understand that acc. to Rav Moshe they never needed to be.

    We do not really need a new heter. Rav Moshe never maintained that the dairy inspectors had to figure out if the milk is from a cow or not. Rather, they had to make sure no non-kosher milk was added in.

    Today, the heter is only stronger than before. Besides the FDA at the dairy, there are state inspectors at the farms.

    I am saying that Rav Moshe says we should be ?????? ??? ????? ??????. He praises the Medina of America and calls it a “????? ?? ???” who helps all its residents with programs, including helping Yeshivas.

    And I think we should be grateful that the Founding Fathers made a constitution and Bill or Rights that gave religious liberty to all.

    Here are my questions:

    1)Poskim advise to say it in a language you understand, bdieved if you say it in Hebrew and don’t understand it, is it a valid hatarah?

    2)Since you are being matir many nedarim at once, with the pesach being the same for many of them, do you counter in every single neder how it affects the other one?

    To give an example, someone has 2 minhag tovas, one to wear a tie by every davening, and one to come early to every davening to learn early in the morning. He wants to do a hatarah for both. Let’s say the minhag tova of coming early came first. Let’s say he never knew the halacha that a minhag tova becomes a neder. Now, if by the minhag of coming early to learn, the pesach would be had he knew the halacha, and that had he known he would not be able to keep it forever, he would have said “bli neder”.

    Fine, but now since he had said “bli neder” by this minhag tov (of coming early) he would not have said “bli neder” by wearing a tie. (for whatever reason).

    But if we look at every neder individually, then the pesach of “he never knew the halacha and had he known he couldn’t keep it forever”, would work by the tie neder also.

    Basically, if we consider the pesach as like it really happened retoracively , then later on it would affect his other nederim and he may not have said “bli neder” But if we factor every neder individually, he would have said “bli neder”.

    So how do we look at it, anybody know?
