Avi K: I work in the criminal justice system. However, we always go through the Supreme Court as we deal with felony prosecutions. As to your other question above about the 19 yea old, he was charged with a Class B felony, not a Class A.

Avi K: A 19 year old with a clean record was charged with attempted kidnapping. His family was without means. His original bail was $100,000 and at that point had not missed any of his court appearances (one of the reasons for bail in the first place). The prosecutor asked for the bail to remain at the $100,000 and the judge upped it to $1,000,000.

BTW, Supreme Court in NYS is Criminal Court.

The original charges had a hate crime and it was dropped. Please don’t tell me a person with 8 prior arrests should be treated leniently even if only charged with misdemeanors for his current arrest.

10 years ago we chastised another judge for setting a $1,000,000 bail on a member of our community for a first offense and well over the amount wanted by the DA. A person who has been arrested 8 times previously and was filmed beating a another human being (for no reason) should have had a higher bail set. Judge Freier (IMO) was afraid that she would have been questioned as she is from the same community as the victim.

Years ago it was very common not to wear taleisim in a visible manner. Many people wore an over coat or in hot weather wore the talis under their jacket. I once heard a drasha from R’ Yechiel Perr, Rosh Yeshiva of Yeshiva of Far Rockaway who explained that wearing a talis in a visible way in the street might have caused an anti-Semitic response. I think he quoted R’ Yaakov that it was proper no to wear the talis openly.

Neville: When was the LA eruv established? The eruv in Brooklyn was controversial from day 1 (either in 1978 or 1979) due to R’ Moshe’s psak. Yes, there were other poskim who argued with R’ Moshe (the Debrecener for one) while others agreed with him (notably Rabbi Bick). The yeshiva olam generally followed R’ Moshe and did not use the eruv while others did not follow R’ Moshe’ psak and used the eruv. In addition, I can personally attest that there was those in my shul who did not verify before shabbos that the eruv was up and came to shul shabbos morning carrying something only to see the “red flag” that the eruv was down.

youdontsay: Yes I understand R’ Moshe’s psak regarding 3 million people in a 12 mil by 12 mil area. That is why the question was asked in 1979 as to why should Queens and Brooklyn be treated differently. Brooklyn has approximately 69.5 mi of land area and Queens has 108.2 mi. Total population in Queens was slightly less than Brooklyn. So why was the entire Brooklyn used cover a 12 mil by 12 mil area but Queens not? I heard from Rav Hillel David the response I gave above as he conferred numerous times with R’ Moshe as he is now and was then one of the noted poskim in Flatbush during the eruv controversy in the late seventies. You don’t want to believe it, fine. I know what I heard from him.

Gaon: I don’t remember you being in the room when Reb Hillel David told this to me. As you may know, not every psak made it to the igros Moshe. Just because you never heard it doesn’t mean an oral interpretation was not given. As an example it doesn’t state in the Igros Moshe that a vegetable peeler can be used on Shabbos but Reb S.B. Cohen in his sefer the Shabbos kitchen page 104 quotes R’ Reuvain that his father held it is a knife. We do know that not every psak is written in the igros Moshe. Rabbi Ribiat says the same thing in his footnote that he has heard that R Moshe says you can use the peeler but it is not in the Igros Moshe.

R’ Moshe held Queens is different then Brooklyn as the neighborhoods are clearly defined as recognized by the US Postal Service. When you address a letter to a Queens address it is not to Queens NY but to an individual neighborhood (i.e. Forest Hills, Flushing) whereas you address a letter to Brooklyn, NY (not Flatbush or Boro Park.

Joseph: this is what was told to me 35+ years ago during the initial controversy. Besides the census figures of residents counted by the census, an estimate of people living in Brooklyn who were not counted bu the census. Remember the last census prior to the eiruv question was in 1970; the eruv question was in 1978 so they to account for people who moved to Brooklyn (legally and illegally) after 1970.

Gaon: I am still not sure why this thread from almost 2 years ago was bumped but I wrote what was explained to me by Rabbi Hillel David. He also told me that unlike Warsaw, R’ Moshe was told that the population in Brooklyn was over 3 million people (this was the estimate in 1979) and he held that it was possible that 1/5 th of the population was in the streets at all times and therefore was a reshuffling harabim doraiso.

Whether we like it or not, Many chazzanim have had choir’s backing them up for years. As it says in Koheles (1:9)
וְאֵ֥ין כָּל־חָדָ֖שׁ תַּ֥חַת הַשָּֽׁמֶשׁ: While these Selichot services are not my type, R’ Shlomo Carlebach led them for years. As I mentioned somewhere else, while there is no musical accompaniment, the videos of the singing of Verushalayim Ircha by the mispallelim of Aish Kodesh (Rabbi Weinberger Woodmere, NY) (available on Youtube) after selichos each year is (for me) tremendously uplifting, especially how the rav dances with the person leading the selichos.
