    That’s an interesting svora, and well thought out.

    The only thing is, while Rav Belsky mentioned the fact that someone sweated over the product’s creation, that point seemed more from the ethical perspective than halacha.

    Ah, that may be different. There is an ethical debate about copying “abandonware”, and further, Rav Belsky permits the copying of music that’s no longer available for sale anywhere: “A CD or tape which is no longer sold in stores and is not possible to buy may be copied from a friend. However, one must make sure that the item is really not available for purchase. Many old tapes are still being sold online (by the original producer or someone who bought the rights to them).

    I don’t know. This was just a quick question I asked at the end of a discussion, and I didn’t follow up.

    Unless Rav Belsky meant Geneiva, when Dina D’malchusa dictates who something belongs to or which rights he has. Whenever you’ll find Dina D’malchusa it is in this context. The Malchus has the ability to be Kove’a certain things. We probably depend on that for the Kinyan of checks and wire-transfers.

    Once again, I don’t know. If an unethical “chochom” tries to play games based on the differences between a halachik kinyan and U.S. law, I don’t know how that would be handled.

    Tosafos in Bava Basra 2b learns that Hezek She’eino Nikkar means a Hezek that isn’t obvious, not necessarily that the loss is not physical. Therefore, planting grapes too close to someone’s field is a Hezek Nikkar, while putting a Sheretz on fruits is not obvious because we can’t tell if they are Muchshar.

    True, Tosfos is clearly using the term “nikar” to mean “you can tell while the damage is being done that it is a hezek”, such as klayim still attached to the ground.

    As far as my disagreement(s) with what you brought down, I don’t really have much to add that I didn’t already say on the earlier thread.

    Whether I agree or not isn’t important. I suggest you discuss some of your points with a magid shiur or Rosh Yeshiva. Some of what you say is logical, and as a halacha discussion, there really isn’t any downside to discussing it.

    I learned several perakim in Bava Kama, but not the entire mesechta.

    That is also like software copying, or better yet, you install microsoft office on multiple computers in your house, using one cd instead of spending hundreds of dollars on as many packages as you have computers and laptops in your house.

    Not at all. Reinstalling software on a crashed computer in what everyone does, with the vendors’ OK. Nobody would buy from a vendor who refused to allow a reinstall.

    1) Not everyone who assurs copying holds that it’s explicit g’zaila (or g’naiva). As a side point, I don’t understand why anyone calls it g’zaila since it seems to be more like g’naiva (to me).

    I apologize for my overly harsh personal criticism.

    Let me try to rephrase what I’m trying to say.

    There’s nothing wrong with looking up various meforshim and poskim to try to support a svoro of yours.

    What is wrong is deriving your own heter based on that for action(s) that many (if not most) rabonim and poskim hold are problematic / assur for various reasons. At the very least, one is obligated to ask a shailo to their rov about the action in question.

    Once that’s done, even if you’ve gotten the OK you must still be careful not to publicly announce that “it’s OK and completely mutar” – you must be very careful to explain that, although your posek may be matir it, there are many who aren’t, and one must be very cautious about the issue (needless to say, gnaiva is serious and Rav Belsky and [lbclc] Rav Moshe aren’t to be trifled with).

    A less contentious example of this is that one who follows Rav Belsky’s psak that drinking water in NYC needn’t be filtered shouldn’t state in a public forum that “it’s no problem”, rather “per my posek, it isn’t a problem, but you should ask your rov”.

    There are also certain issues/halochos that should not be discussed on a public forum for obvious reasons (v’hamavin yovin).

    His posts encouraging software and music piracy are disgusting and (to me, at least) a chilul H-shem. We can imagine the impression being conveyed to non-observant Jews and non-Jews.

    …many restrooms nowadays (including in some yeshivos) have paper towel dispensers that work with a sensor. The problem is you can’t use them on Shabbos.

    I’m surprised a yeshiva would have that. What do people do on Shabbos?

    Public restrooms should all have a way to get hand paper towels without having to touch the germy, wet surface of a handle that needs to be pumped to dispense the paper.

    This can be accomplished via an electric eye, a foot pump, or the brown paper towels we are all familiar with from yeshiva.

    There are other unsanitary / yucky surfaces in public restrooms too, but they can be worked around.

    That being said, I do like the idea of there being a user-based method of flagging trolls. However, it should not be done on the public forum. I think that it would be nice if there was some sort of line of communication straight to the mods dedicated to flagging troublesome users. However, I don’t know how difficult such a thing would be to execute, so I don’t know if it’s something we can expect.

    This isn’t an invention, but a suggestion for improvement:

    Valet parking at simchos in Brooklyn usually means street parking, possibly several blocks away.

    If the valets had small motorized foldable scooters available, it would increase the range of parking spots they could use and also speed up the cars’ retrieval process after the simcha.

    The scooters should be foldable and have electric motors, to minimize noise and mess. They will need to include something to protect the car’s mats in rainy weather.

    Another “parking” idea:

    A small printer should be available to print out a tiny street map (index-card sized) showing where a guest’s car is, for those who prefer to just go get it themselves when they leave.

    The ipod was repaired at the store “cb1” recommended.

    The cost was $50.

    I saw the repair job, and to my untrained eye it’s indistinguishable from an original screen. The ipod’s owner is very satisfied.
