    Power for merging onto a highway is important, but almost all cars nowadays have plenty. The Atlantic Avenue BQE entrances (both sides) are examples of short merge lanes on a busy highway that make merging difficult at times.

    Horsepower is how powerful the engine is.

    Torque is the force the tires are being turned with.

    I’m by no means a car enthusiast, but, out of necessity, I learned a bit about cars and their repair while in yeshiva.

    Upon further review, my point of “ain adam masim atzmoi rasha” is on shaky grounds here for the following reasons:

    1) The original action probably doesn’t qualify as rishus. If anything, he would simply have to compensate the owner for the difference between leshmo and shelo leshmo matza. (If he claims that he actually switched the matza with outside matza, that may be more severe).

    2) The “masim atzmo rasha” would be that he’s admitting that he is trying to steal. However, his attempted blackmail is (I’d think) g’zaila in itself, so you see he is a rasha as far as that goes.

    I didn’t go thru the entire Tosfos yet, just the first couple of lines (where he distinguishes between aidus and shtar). B’n I will. I think I see where you’re going though – this case is aidus, not shtar.

    Corrections:

    1) “omitted” in the last paragraph of my previous post should be “committed” – although my point was probably understood, this changes the meaning 180 degrees.

    2) The Tosafos in Kesubos ?”? ???? is on 18b. I looked at ?”? ??? on 18a for a couple of minutes before I thought to turn the page.

    A possible answer to your question is that the blackmailer claimes he swapped out the leshmo matzos with non-leshmo matzos baked elsewhere.

    Believability:

    1) Is there a chiyuv here to believe the blackmailer’s claim that one box contains non-leshmo matza?

    2) How about if the blackmailer claimed one box contained matza that was vadai chometz?

    3) What if the blackmailer’s claim is that one box contained traif (or otherwise ossur all year around) matza?

    Rov / Chazaka:

    1) Do rov and/or chazaka come into play here?

    When and if the blackmailer confesses:

    1) Do we believe anything he says when and if he confesses as to which box is tainted?

    2) Can we trust him that he hasn’t tainted more than one box, or actually traifed up some matzos?

    The “masim atzmo rasha” I see here wouldn’t be baking shelo lishma, or even making it chometz – it would be sabotaging the goods he’s paid to produce in order to blackmail the owner.

    A nafka mina (where I couldn’t claim “ain masim”) would be where he claims he b’shogeg forgot to have leshmo in mind, but now that the deed is done, he wants to blackmail the owner.

    As far as palginan, that’s an interesting point. I’m not sure if this would be like the case of eidim who claim they were coerced monetarily (who we don’t believe, thereby showing that someone who claims they omitted an aveira just for monetary benefits isn’t believed), or other cased where we disregard the “passeling” portion of their testimony, and believe a part of it; hence the “palginan”.

    What about ain adam masim atzmo rasha?

    If we believe that he put faulty matzos in a box, we certainly couldn’t trust him that this was the box, and no other box was tainted.

    WE ARE TALKING ABOUT A HUMAN LIFE HERE.

    The facts as given in the news were:

    -The patient could have been saved.

    -There was not a DNR in effect.

    -The operator desperately tried to get the nurse to do anything to save the patient, even finding a bystander willing to perform CPR. The nurse flat out refused.

    Derech Chaim is very focused on learning.

    Some of the lower shiurim are on an easier level than you might find at other batei medrashim.

    The yeshiva is very serious about the learning on all levels, and talmidim are expected to be full-time learners. College is not allowed.

    Several alumni are now rabeim in Derech Chaim and other yeshivos.

    The learning and shiurim are all in English.

    The bochrim are more Litvish than anything else, but there are a significant number of Chasidim and Sefardim, too.

    10 days ago, I sent an email to family and friends of Partners in Torah about 2-year-old Yoel Feder. The response to that email – over 70 emails to date – was simply overwhelming. People from all walks of Jewish life committed not only to praying for Yoel but personally committed to a mitzvah in Yoel’s merit, as Yoel’s mom requested. Some spelled out the specific mitzvah they took on (to name a few… going to Western Wall to pray, not speaking lashon harah, giving tzedakah, studying more consistently with their Torah partner, praying on a regular basis, baking and separating). Others were less specific. One woman wrote “I did a mitzvah this evening that was very difficult for me as a merit for little Yoel”. Several people offered financial assistance, one person sponsored 10 pairs of Tefillin! Virtually everyone asked for an update on Yoel’s condition. My apologies for not responding to those requests until now. There simply wasn’t anything new, nor anything encouraging to report. Seeing him again in the hospital, hooked up to the most sophisticated life-sustaining equipment, was a painful sight, one which I was reluctant to detail.

    As I was checking my emails after Shabbos this week, I noticed a message from Michelle Feder, Yoel’s mom. It was obviously the first message I opened. Attached was the most beautiful video clip I’ve ever seen in my life. It was of Yoel, partially emerging from his induced coma, trying to talk, squeezing his mother’s fingers, and wiggling his tiny little toes. Along with the video was this message from Michelle: Dr. knocked on my door in hospital and told me that Yo is saying daddy !!!!! He is moving his feet a little. This is the first day of progress we saw!!! This is all b/c of everyone’s tefillos (prayers) and tzedaka !!! Please keep davening for him. We have a long rd ahead but Avi and I are just holding his hand. He is squeezing my hand!!!

    While Yoel has had ups and downs in the past couple of days, the doctors are hopeful but have stressed that he has a long road ahead of him. He has one eye open but cannot yet see. Please G-d, he will be seeing perfectly sometime soon. They took out the shunt in his brain, a truly encouraging sign, but he has multiple skull and facial fractures and will require several surgeries. The doctors are talking about 6-12 months in a special pediatric rehab hospital.

    Yoel’s parents are extremely grateful to each and every one of you for your prayers, mitzvot, and good wishes. They have made two requests: that everyone keep praying and doing mitzvot, keeping in mind the name for Refoel Yoel Ozer ben Chaya Malka. They also wrote the following: “There is a tzedaka that is near and dear to our family. If anyone would like to give tzedaka for Refoel Yoel Ozer to have a full refuah (recovery), we would be soooo happy. The Special Children’s Center, 1400 Prospect St., Lakewood NJ 08701. This tzedaka helps thousands of Jewish children with severe disabilities: Please put on memo of check for refuah for Refoel Yoel Ozer. Thank you so much, everyone!!!!!     May I suggest that those of you studying through Partners in Torah mention Yoel’s full Hebrew name before commencing your study. May I also suggest that those who do not currently have a Torah Partner sign up today in Yoel’s merit.

    All emails describing what people have done in Yoel’s merit have been forwarded, and will continue to be forwarded to his parents. They’ve expressed the following several times: “it’s keeping us going”. Please accept my apologies for being unable to respond to individual requests for updates. Rest assured that your prayers and mitzvot are still needed. As mentioned already, this is going to be a long haul. Please G-d, I’ll have extraordinary good news to share real soon.

    With Purim, the holiday of hidden miracles, just around the corner, please join me in praying that the Feder family experience a complete transition from darkness to light, and from sadness to rejoicing.

    Who is right? Neither.

    She was a stupid kid. Someone should have warned her to show respect and decorum before a judge, and that there could be a price to pay if she didn’t.

    He was a bully and a tyrant. He provoked her by doubling her bond, taunting her with a sarcastic “Adios”, and then when she snapped and cursed at him, sentenced her to a month in prison.

    Just curious – is there a limit to the length of the “contempt” penalty a judge can give? Let’s say he wanted to send her off for five years – could he?

    Based on that they can decide:

    -How much data they need in a plan

    -Who their plan provider should be

    -How much memory the phone needs (for videos, music, applications)

    -How important long battery life is

    -Which features are needed

    -Which screen size and overall phone size is best

    Please feel free to ask for additional info and/or clarification.

    Also, some advice. Not meaning to lecture, but I suggest that when people respond to your request for info:

    1) You thank them, or at least acknowledge them.

    It’s a shame that the well of trust has been poisoned.
