    The Ohr Chodosh (to parshas V’yaira) says that RSBY had reached the madraiga of a ” malach saraf” and that he was “no longer compatable with this world and the world was not compatible with him”.

    (The aruch hashulchan has a similar p’shat in why the malach replied to Manoach that his name was Peli. The ability of a malach , which is pure ruchnius ,to interact with humans on this world is a ” daver peleh” Similarly we say in asher yatzar ” u’mafli laasos”; this relates to the great nes required to keep the nefesh and guf working together)

    In any event , I don’t think its fair to say RSBY “forgot” about the common man ; he transcended mankind.

    I also saw in Minhag yisroel torah that the minhag is specifically burn clothing. ( thus the complaints about bal tashchis). He brings down that the basis for the minhag is that RSBY became like adam harishon kodem hachait. Just as Adam and Chava had no need for clothing, so it was with RSBY.

    Based upon personal knowledge ,the caliber of the boys at the yeshiva has risen dramatically in the last few years .There are top notch kollel yungerleit and both of the roshie yeshiva are known iluyim.Rabbi drillman’s shiur is really for top boys. There is an excellent shiur for younger bocherim as well.

    silly response. Those are your words. I was suggesting that we celebrate the fact that a person could reach such a high madraiga. Why don’t you complain to RSBY for killing poor innocents? ? Maybe he was chaiyiv misa for what he did? And, how do you know these were people working to support their families? perhaps they just wanted some extra cash ? We obviously do not know the exact meaning of this maasa ( although, of course he was told to stop or there would be no world left). But in my humble opinion it is brought down as a shvach of RSBY.

    Just thinking out loud: perhaps the minhag is related to gemorah which describes how right after RSBY left the cave where he had been hiding and learning with his sont he was on such a high madreiga that any gashmios that he looked at was burned.

    apushata: if you accept the idea that davening is “us talking to Hashem” while learning is “Hashem talking to us” then learning , especially while waiting for the shliach tzibur, or bain gavra l’gavra is just a shift in the conversation. Looking at one’s phone messages, or actually typing an emails during davening is a chutzpa beyond belief. I have no problem with someone davening from a phone . (personally I never carry a phone exempt on busniuss trips… and I still don’t know how to text.)

    If I were a great chasideshe rebbe of days bygone I would say” Ribbono Shel Olem , look at your children; even when they are playing with their phones they are davening to you” However being a calter litvak, I say anyone who is texting or reading messages on his phone should be thrown out of shul together with the talkers.

    not to pasken but the Gemmorah says kol hamavazah es hamoados k’ilu oved avodah zarah. Rashi learns that this refers to chol hamoed.So while going to a game for kids may be ok, adults should think long and hard about it.R’Yaakov Kameminetzky ztz’l famously said chol hamoed is yom tov with a few kulos.

    One of the rayos to wear tefillin on chol hamoed is from today’s daf!.The gemmorah brings down that R’ Shaishes allowed teffilin to be sent on Yom Tov. The hagaos ashry ( and Tosfos in Eiruvin )ask our Mishna allows only gifts which can be used on the “moed” to be sent on Yom tov. They answer that ” moed” in our mishna refers to chol hamoed and prove that tefillen are worn on Chol H’amoed . However the G’ra notes that the girsa of the Yerushalmi is ” af al pi shain tzorech yom tov”. Also the Tzlach asks what about the last day of tom tov or Shavuos, when there is no day of chol hamoed after. … according to the hagaos ashri the gemorrah should have not allowed tefillen to be sent on those days. A gut Yom Tov to all.

    Interesting story: About 38 years ago on chol hamoed I was (a kid) davening in ( the old) Chaim Berlin- in the ladies section which was about 5 feet up and had a curtain. there were about 20 of us tefillen wearers sitting near the curtain. Suddenly Rav Hutner ztz’l comes in, through the ezras noshim, and surveys the tefillen wearers. He gives a majestic wave with his silver topped cane and in a booming voice announces: “DE ALLE MIT TIFFILLEN ZOL GAIN TZUM ANDRE ZIET FUN EZRAS NOSHIM.”( ALL THOSE WITH TEFFILLIN SHOULD GO TO THE OTHER SIDE IF THE EZRAS NOSHIM). He obviously felt quite strongly about lo sisgodidu!

    I do, but I try to be careful to daven with a minyan of all tefillin wearers.(there is a very nice tefillin minyan at Bais Yosef Nevardek in Flatbush at 8:30)This avoids the problem of Lo Sisgodidu. Its interesting, my father- in -law says that 50 years ago almost everyone wore tefillin; nowadays I’d say at least 80% don’t.

    Wolf- I often face the same dilemma. However I carry the (large size)Mesifta gemora as well as the (large size) Artscroll to work each day; I am fortunate to be able to do much of my learning at work. But there is no way I can carry any more volumes so I make sure I have completed a volume the night before.

    I probably should have posted this on the “is it mutter to lift weights” thread as well:)

    Allowing yourself to be thrown on a tinok is neither a grama nor karka olom. Rather, it is an act attributable soley to the thrower- with you being used as a “rock”. The reason It is important not to call it karka olom is that according to the Tur and Rambam there seems to be no heter of karka olom. However, here, where you are not participating in and play no role in the avaira, everyone would agree there would be no din of yeharaig v’al yavor

    “the svarah is not a strong svarah”

    There are two explanations for the svarah of chazi l’itztaryfai. According to the Tzlach ( and others) the Torah assered any amount since one might be oiver the issur kares by completing the shiur.

    According to the Shagas Aryeh ( and others) the svarah is that if the torah gave kares for a full shiur then it is axiomatic that all of the components that got you to that shiur ( i.e. every little bite) must have been a cheftza shel issur.

    um, I think I just referred to that tosafos. Actually, if you look carefully you will see tosfos actually ask the reverse kasha…. i.e. if there is a posek why do you need a svarah.

    L.F. – The Meri learns like you that R’ yochonon’s real limud is from the svara. Of course the top tosfos learns that the possuk is the ikkur and the svara just confirms that the possuk is not an asmachta.

    The Ritva says the svarah of chazi litztarufai, is the reason the Torah asssered chatzi shiur ( taima d’krah)…. however the issur is learned out from the possuk

    The Achiezer learns there are 2 dinim. FROM THE POSSUK OF KOL CHAILEV WE WOULD KNOW THAT THERE IS AN ISSUR…. but not an issur of chailev or nevailah.A stam issur. The svarah of chazi litztarufai tells me that the issur is chailev or nevaila Ayin shum for the nafka mina. ( sorry for the typing, my sec. left early CAUSE OF THE SNOW)

    Its not rocket science. Endiomorhins are released during extreme exersise. This provides the high. Work on a sugya for 8 hours till you have it totally clear and your neshama will experience a high.

    As a percetage of ALL lawyers those in big law are a distinct minority. Considering that frum yiden make up less than 1% of the U.S. population , they are in fact overrepresented in the big firms.Getting into columbia or n.y.u essentially assures you one of those jobs(if you want it). Any other school and i’d agree – go for the scolership and try to make law review.

    Akuperma, I disagree with each of the points made in your post. 1. There are hundreds of frum lawyers working at the “top 20” law firms.At 90% of these firms there is no discrimination against frum jews. ( perhaps the only exeption is where the applicant has a beard or payos).

    2. dewey lebouf is having more than “problems”. they shut down, fired all their employees and filed for bankruptcy over 6 months ago.

    3. However, to extrapolate to other firms is wrong.in the last 20 years the only similar case was Finley kumble, in the 90’s (and at a smaller scale, Heller Erman.) The other large firms are still paying incredible starting salaries with 30-40k in raises each year.Also,whereas in the past if you didnt make partner after 7 years you were out the door, now they have sr. associate positions paying about $500k. I’d say the risk of any large law firm closing down is less than 1%.The only reason going to a big firm may be a “dubious” choice is because,in most cases ,you will work till 10 every night leaving very little time for the other things in life we hold dear.

    There are rishonim that hold “La’celev tashlichu” is actually a mitzvas assai.I heard that there were gdolim who made it a point to feed stray dogs in accordance with this shitah.Nevertheless, there is a gemorrah (forget where) that says that when the dog is going to not leave you alone you may kick it away.

    At Columbia law , 1988, there were 7-10 yeshiva guys each year( and 1 or 2 frum girls). Every one of us stayed completly frum. Because we were such a small minority we stayed amongst our own. RD , perhaps in your (proudly) MO world you have a problem with kids going to university.It really is ironic: the MO’s who preach to us how importent secular studies are are the ones victomized by university, while the yeshivish crowd remains unaffected by it.Not really surprising , if you think about it.

    I cry every year during Aicha …beggining to end. Also during n’eila. then my eyes stay dry the rest of the year. (the gemorrah notes that crying after age 40 is injurious to the eyes.)

    it is not a shogeg. There is no lack of knowledge that it is Shabbos or that nail biting is assur.Those are the only two types of shogeg on Shabbos. What you most likely are claiming is that because the nail biter does so without thinking about it is a misasek.I don’t believe that doing something by rote meets the requirements of misasek either.There needs to be a real lack of daas that the act was assur( mischavin l’talush…..)

    Here’s what I do. every week before Shabbos I cut my nails (and surrounding skin)with a nailclipper till it is impossible to bite or cut any more.My fingers look pretty horrible but as a man i can get away with it… and it precludes chillul shabbos.

    I think it is wonderful that think that white shirts have become the norm in the yeshiva world. I am troubled , however, that almost every bochur and yungerman feels compelled to send their white shirts, on a daily basis, and at great expense, to the Asian American laundry.

    If you think about it, the medrash is astounding. The third bais hamikdash is here; Moshiach is standing on top of it telling us that the long awaited geulah has finally arrived … and yet” v’im ain atem maminim…”. How could anyone not belive at that point?

    Sam, I am familiar with the Rambam.While the Rambam often cites “reasons” for mitzvos in moreh nevuchim, it is beyond obvious that he accepts the principle that all mitzvos have countless unfathomable “reasons” behind them and if a particular reason no longer applies the mitzva remains eternally. The apikorses lies in the conservitives’ idea of doing away with mitzvos which they determine to be no longer applicable.

    I once came across a conservative siddur and flipping through it I, at first, had the same impression. Untill I reached “ritzai” in Shmonah Esrai.There,they delete two words: ” v’ishey yisroal”. In a footnote in the back of this siddur it is explained that while karbonos were importent at the time of mattan torah in order to assure that there would be no human sacrifice,which was common then, nowdays we have no need for karbanos and we certainly do not look forward to,much less pray for the restoration of, any practice which involves cruelty to animals.So, with the deletion of 2 words, their siddur becomes not only different than our own, but pure apikorsus.(cf the Bais Halavi’s pshat in the raha’s question in the haggadah)

    I don’t see how there could possibly be an issur of moitzi sifasecha or lo yachel.If there was, how would mechila work? For example, i agree to pay (or repay) you $50 or I agree to paint your front porch. You then are moichel.If there was some din bain adam l’makom i would still be required to pay you or paint your porch. (I used the second case to preclude a “k’ilu hiskasbalti” argument.) Moreover, even in the cases of nidrai zeruzin, where one actualy says that he swears that he wont sell an item below a particular price or asssurs his friend from hanaah if he doesn’t attend a simcha…. chazal determined that the neder is simply invalid. I am unaware of any indication in the gemorrah, meforshim or poskim that one should nevertheless” keep his word”. Its either a neder or it is not.
