    but i preface such a Tefillah with a plea to Hashem that if such a Tefillah is not proper that Hashem should not listen to it and should forgive me.

    Why not ask a shaila as to whether it is proper or not?

    He was under no legal obligation to attend. (And if he had been, that would not be a mitigating factor, unless — perhaps — it would have cost him his life.)

    You have the problem in reverse with Yom Hoatzmut, which is supposed to be (by design of its authors at least) a day of celebration — during the Sefira.

    Can you hold the no shaving/no music for the last 33 days of the sefira, instead of the first 33? That might be a way around this issue.

    Because we have Tisha B’Av for this purpose. And 2) because only the rabbonim can institute a new “celebration”.
