OK all… I have a confession. With G-d’s help, and only through His blessing, we are making aliyah in three weeks. Woo hoo! A question has come up among a chevra of us making aliyah this summer…
If one living in the US has signed a commitment to make aliyah with the intent of living there for life, has already leased an apartment, has already sold his US home and goods, and has made a financial commitment go make aliyah (if you don’t move there is a financial penalty), can one consider himself Israeli and keep one day of Yom Tov?
Before you jump on me, we all concluded “no.” But we wanted to discuss sources as to why. I don’t know any off hand.
What says the community?

In that case he keeps like it is kept in chutz laaretz. He didn’t make the actual move yet so he still a resident of chutz until he makes the actual move.

A son in law of Rav Shlomo Zalman Auerbach zt’l spoke at our shul between Mincha and Maariv during one of the days of Yom Tov a few weeks ago. He mentioned what happened when his son (Israeli) married an American girl (daughter of the Novominsker Rebbe) shortly before Pesach many years ago. The couple remained in America until after Yom Tov. The chosson was Israeli, kallah American, planning on moving immediately after Yom Tov. He asked his shver (RSZA) and was told the kallah must keep two days. Planning to move, even in conjunction with marraige, isn’t moving. (The discussion was not even on that topic. It was regarding arvus in brachos, and can a husband who is not keeping the second day of Yom Tov be motzi in Kiddush his wife who is.)
All of the above was only meant as an anecdote. Please don’t ask halachic shailos to the coffeeroom.

Shovu’os depends exclusively on timing of Rosh Chodesh Nisson, being 9 weeks & 1 day after Roch Chodesh Nisson; This being so, even in olden days, after 9 weeks everyone knew when Rosh Chodesh Nisson had transpired, which by default makes entire institution of Yom Tov Sheni by Shovu’os even wishier washier than by Pesach & Sukkos.

‘scuse me, we in Golah follow our mesorah, as instructed by the great Rabbis of Eretz Yisroel. ????? ????? ??????? ??????. That has always been our call, our following. That was our perseverance, our resolution, indeed our hope, as we struggled to uphold Torah throughout our years. We follow our Rabbis and the Mesorah. We don’t allow for modern calculations, innovations, “emendations”.
Rabbis long ago knew of your brainstorm. Nevertheless they instructed us to make a two day Yom Tov with all halachos that apply, Brochos, Tefillah, Kiddush etc. And the halachos of one who is mezalzel in Kedushas Yom Tov Sheni…

Poskim say it actually might be more stringent, since it was instituted as a vaday rather than a safek (although I’m not sure I understand that; why should a “lo plug” be more chamur than the original din?).
Either way, I agree with LF that the term “wishy washy” should not be used in this case.
