it is extremely dangerous and has killed many people. one word can ruin ur life forever. do u text whikle driving or let ur children??
January 23, 2011 3:34 am at 3:34 am #732129AinOhdMilvadoParticipantI NEVER do.
I think it is very close in severity with DWI.
Personally I feel if someone is caught driving intoxicated, even the FIRST time, they should lose their license for at least 6 months to a year, and if caught a second time should lose it permanently.
I think a person caught texting while driving (and it would have to be PROVED (cops DO lie – and might say for example, that you were texting just because a phone was in your hand) – but if proven, the fine, even for the FIRST time should be HUGE, like $350 to $500.
I think THAT would make most people think before doing it again.

Its illegal. Parental permission is not a factor.

January 23, 2011 5:05 am at 5:05 am #732136kapustaParticipantNope. Too many stories have made me incredibly scared too. (That, combined with being straight out stupid and against the law.)
Before texting behind the wheel, a person should think of what to answer after 120, after knowingly putting many lives (driver, passengers, other cars, pedestrians) in danger.
January 23, 2011 5:07 am at 5:07 am #732137cofeefanMemberi put my phone away in my bag while driving and only take it out when i am where i need to be or pulled over. its very very dangerous!
worst thing i saw was someone texting in middile of the big snowstorm here in NYC i was so upset!

Despite that it is per se negligent. I actually stopped briefly when I realized that, but then remembered that I also speed.

All kidding aside, I think it’s as much or worse the being intoxicated. Eyes and mind are both distracted. Talking at least have eyes on the road.
January 24, 2011 6:32 am at 6:32 am #732144truth be toldMemberchayav: Did you know that skiing is a lot more dangerous than texting while driving nd has a lot more accidents proportionally? Its not even close
January 24, 2011 3:08 pm at 3:08 pm #732145chayav inish livisumayParticipantPopa that’s the crummest svara I’ve ever heard. First of all just cuz u do one thing wrong doesn’t mean u should do another thing wrong. Second texting and driving is much more dangerous than speeding cuz when u speed at least u are paying attention when u are texting you aren’t even looking at the road.
Truthbetold that’s a bad point also. Statisticly jumping off a roof has a higher percentage of deaths than driving with your eyes closed so let’s all drive with oyr eyes closed because its not as big of a risk
What about texting with a flip phone if you can text without looking at the phone??
January 24, 2011 3:49 pm at 3:49 pm #732146apushatayidParticipantThere is a frum girl in brooklyn who was charged with negligent homicide for killing someone due to a distraciton of texting while behind the wheel of a car. utliize all krum svaros you want, but please dont text while driving if you are anywhere within 500 yards of me or any member of my family.

I don’t think popa_bar_abba was concentrating when he posted this. He was probably posting from his mobile device. While driving.

“There is a frum girl in brooklyn who was charged with negligent homicide”
I believe the charge is death by reckless driving.
January 24, 2011 7:46 pm at 7:46 pm #732149real-briskerMemberThe oilum is not chaping the amkus of popas post. I dont think popa actually texts while driving, I think he was just trying to point out that why is everyone making such a big deal about the danger of texting while driving, just stick to no speeding that is also very dangerous, and I’m sure not everyone that doesnt text also doesnt speed!
January 24, 2011 8:23 pm at 8:23 pm #732150klachMemberspeeding well over the limit is dangerous but five, ten iles per hour is not. In fact, studies have shown that it is more dangerous to drive ten miles under the limit on a highway than it is ten miles over
January 24, 2011 8:24 pm at 8:24 pm #732151klachMemberanother study said thaat someone texting while driving has the reflexes of a 65 year old. So. . .
January 24, 2011 8:30 pm at 8:30 pm #732152bptParticipantTexting is almost as bad as DWI.
There’s a YouTube clip (made in England, I think) that shows the extent of how texting can kill.
That, and just a few months ago a person in Bklyn was involved in a “minor” accident, but it pushed someone into traffic. So while the accident itself was not so bad, the result was very bad.
Put the phone away!
January 24, 2011 8:44 pm at 8:44 pm #732153seeallsidesParticipantThere are a few youtube videos of horrific accidents by texters while driving-i am terrified when i ride with someone who has their hands off the wheel, they just don’t see how their coordination is off – yes speeding is dangerous, and skipping stop signs is terrible – everybody knows that – texting is a newer danger, and we have to SCREAM about it. MADD started alerting people to drunk driving, and now we have to protest against texters while driving -maybe even texters while walking.

Texting is almost as bad as DWI.
Maybe it’s worse? Do we have any stats?

Why Texting While Driving Is Worse Than DWI
By : Jay Jacobson
Car and Driver performed research that considered a drivers distance and response time to come to a stop travelling at 70MPH. The study revealed that it took the drunk driver four feet further to come to a stop compared to the sober driver. The shocking part of the study came when they examined texting while driving. It took the one that was texting while driving 70 feet to stop in comparison to the sober driver.
Texting while driving removes 3 important things required for safe driving:
1) You Hands
2) Your Eyes and,
3) Your Concentration
A driver who’s texting makes use of his hands, eyes, and concentration to text. This places them as well as everyone else around them at risk and what makes texting while driving more dangerous than an intoxicated driver.
Let’s undertake this line of thought a step further. There’s 800,000 people at any given moment who are distracted by means of texting and driving. Dangerous driving conditions in our day are at a whole new level. With 800,000 texting you can be fairly certain that there may be someone close to you who is distracted by texting.
The statistics demonstrate that driver associated accidents and fatilities are up due to the lethal grouping of texting and driving. Join us in making an individual pledge in saying “NO” to texting while driving.
January 24, 2011 9:07 pm at 9:07 pm #732156twistedParticipantI saw a picture and story somewhere where a pair of people were texting, (driver and passenger), they missed a stop, cut of a motorcylist who could not stop in time. The cycle and its occupant ended up in the front seat, three dead. This and the English PSA should be enough to scare sense into just about everybody but the sense disabled.
January 24, 2011 9:49 pm at 9:49 pm #732157popa_bar_abbaParticipantThank you RB.
I did mean to make that point.
But, I really did go through the thought process I describe.
I used to text and speed, and talk on the phone, and roll stop signs. One day, I heard about the law of per se negligence, and realized that I should not text, since the legislature had clearly decided that it was negligent. But then I remembered that I also speed, which showed me that I do not recognize the legislature’s definition of negligence. So I took out my phone and texted.
If you see some guy in a green civic with a SHMUZ magnet texting away at the wheel while speeding and rolling stop signs, it is me. Better get out of the way, because I can’t see you.
I’m sorry if this makes anyone upset. But really, you are going to get mad at me? Do you get mad at all your friends if you see them talking on the phone or speeding? (when you are not in the car.)

January 24, 2011 10:45 pm at 10:45 pm #732160popa_bar_abbaParticipantOh, and if any of you are wondering (like maybe all you law students who need to know this), the law of per se negligence is that if you are doing something which is illegal and is outlawed for safety reasons, then you are presumed to have been negligent if you injure someone.
January 24, 2011 10:59 pm at 10:59 pm #732161apushatayidParticipantSAC. Im not sure if “death by reckless driving” is a legal term 🙂
But yes, someone is dead because she was distracted by texting while behind the wheel of a car, and in her case she was at a red light.

Legal term or not, thats the charge.
Popa
Are you going to tell that whole shpiel to the family of the person you kill?
January 25, 2011 3:47 pm at 3:47 pm #732164apushatayidParticipantI’m aware of what she did. the technical term is negligent homicide.
January 25, 2011 4:06 pm at 4:06 pm #732165SacrilegeMemberI’m not 100% sure on this but, I think the reason that she was charged w Reckless Driving and not Negligent Homicide (as you are want to say) is because texting is a lesser offence than driving while intoxicated. Had she been drunk or under the influence of drugs she most probably would have been charged with the higher count of Negligent Homicide.
January 25, 2011 4:12 pm at 4:12 pm #732166Baruch BohmParticipantPopa, you shouldn’t text while drive, not only because of the statue, but because you value your own life and the lives of others.

Thanks for your post. Until you chimed in, it seemed that this would be one of the few times everyone agreed. Then you got everyone except real-brisker to believe that you condone texting while driving, and made this a little more controversial. Good job.

If you kill someone TWD you wouldnt get charged with those counts, they are far too harsh (unless they enact stricter penalties for TWD as a primary offense)
January 25, 2011 6:16 pm at 6:16 pm #732177popa_bar_abbaParticipantOk. I have no idea. I just pulled up the homicide code and copied everything from the lowest level to just before second degree murder.
If I had to guess, it would have to go into a vehicular manslaughter one, but I don’t know how those work.
