    When sitting on the toilet or sitting on the bed as you are getting into it, should one minimize the amount of time he sits there (before Chatzos) or can he sit there longer than necessary?

    I’ve had the same shaila. Obviously common sense comes into play, but should one try to be in these more comfortable positions for less time? I can easily see myself trying to be on my bed for as long as possible…

    this is an important shaila and requires a long response. i will be as breif as possible.

    if you are sitting on your bed doing something of importance, for instance writing, you can stay for longer. if you are sitting on the bed cecause of the comfort it provides, you may have to shorten the time you spend on it. texting/emailing freinds is not considered important, but for business it is ok. if you get a call from a friend and you might stay on the phone for long, you must get off of the bed.

    as for the toilet, okay here it gets complicated.

    if, in your bathroom you have magazines that you MIGHT read. you can stay for 2-3 minutes max. for magazines you WILL read 1-2 mins max.

    if you have no magazines, you can stay as long as you need to with out being too comfortable.

    as i said before, this is a complicated issue and you should ask your local rabbi

    i must say, i thought this was a joke but i see others feel it is serious.

    nowadays people play iphone games instead of reading magazines. whats the deal with that time wise?

    All those posters who advocated using common sense are correct. Sheilos of this sort must be humorous at best. One of our great uncles (He wasn’t so great, himself.) asked this type of shaila, in order to impress his father what a frum boy he was. His name happens to be Eisav. One day he asked his father, our Great great…. Grandfather Yitzchak, “How do We Give Maasar of Hay and Salt”, 2 items that are not eligible for Maasar. He then went on to hunt animals for fun & games.

    According to you Shein:- Should the guy doing Hagboho on Tisha b’Ov morning sit with the Sefer torah on the floor? {Just be careful that the open Sefer Torah does not nick the floor as he is sitting onto the floor}

    147 wow you do bump up threads at the most unexpected times! I always try not to get into a car before chatzos on tisha b’av and rather walk to shul at night and for shacharis

    There are special potties made for Tisha B’av which is 11 inches high and conforms to halacha. At Eichler’s, they can be found next to the Shabbos bathroom paper and across the aisle from the chametz packets which sell for only $1.99 each. They are wonderful as the ten pieces come individually double wrapped and you get the b’racha included as well. America, what a wonderful country!

    I didn’t see this last year, but I always try not to sit on the toilet longer than necessary on Tishah B’av. Shein has a point. If you’re not actually using the toilet at the moment, then you’re sitting on a chair. (e.g. if someone is reading in the bathroom and wants to finish the article/chapter/whatever before he gets up, Lich’ora that’s a real problem).

    A Rov told me most poskim hold you can sit on a regular chair after kinus, even if before chatzos. I hadn’t heard that previously. Who are rov poskim?

    @Csar – not sitting on a regular chair is ‘just’ a minhag. It’s not a major issue.

    That said, it is not something a person should take lightly. However some do overexaggerate the importance, as it if were a major halachic issue which it isn’t.

    You really should not be reading magazines on Tisha B’av because it is considered being mesiach daas from the aveilus and the taanis.

    Joseph – No, because according to the halacha, it is forbidden l’chatchila to daven when one feels any urge (no matter how slight) to relieve himself. Rather, one must relieve him or her self and then proceed to daven with a clean body.

    pet peeve of mine. those who bring all sorts of pillows, cushions and lower to the floor leather chairs to shul on tisha bav. they forget the minhag is to sit on the floor as a sign of aveilus, not that there is a din bidavka not to sit on a chair. the sitting on the toilet question blurs these lines as well. as was pointed out above, reading a magazine even while otherwise occupied in the bathroom removes ones mind from the state of the taanis and mood of aveilus. now for my psak. once already reading, sitting a little longer makes no difference since one is already not involved with the aveilus.

    apushatayid – my personal feeling is that it might not be assur to read a magazine while using the facilities (although it is probably better to try to avoid it) – since you can’t do anything else anyhow (kind of like the idea that it’s not a problem of Bittul Torah, although it’s not exactly the same), but to stay longer to read would definitely be assur.

    In terms of sitting on one’s bed: I don’t think there is any heter to sit on a bed. Lying in a bed in order to sleep is obviously mutter, but I think that one should try to get up as soon as he wakes up, and not remain lying in bed awake for too long.
