This is a question to anyone who may have the answer, i have seen some pictures online of the children of Rav Ovadia Yousef ZTL sitting shiva and it seemed from the photos that they did not tear kriah also i was wondering if they put on teffilin during shiva because in th ephotos they are only wearing taleisim

And everyone puts on Tefilin during Shiva. Just not the first day.

Huh? Why?
October 8, 2013 10:54 pm at 10:54 pm #978804Torah613TorahParticipantMaybe the place where they tore kriyah is not easy to see in pictures.
October 8, 2013 11:36 pm at 11:36 pm #978805LublinerMemberno teffilin the first day of shiva? or no teffilin until the kevura?
October 9, 2013 12:17 am at 12:17 am #978806Sam2ParticipantLubliner: No Tefilin until the K’vura is a Din of Aninus. It also isn’t worn on the first day of Aveilus (maybe they put it on at Mincha, I’m not sure about that; but definitely not at Shacharis).
Wallflower: The Mechaber Paskens that an undisputed Gadol HaDor has the Din of a Rav Muvhak, for whom you tear Kriya. An undisputed Gadol HaDor is incredibly rare nowadays (indeed, R’ Elyashiv probably didn’t qualify because not all Poskim were Kafuf to him), but R’ Ovadia almost certainly qualified as one for the Sephardic community.

You could make that into an argument saying that when a rebbe dies all of his chassidim should tear kriyah because he’s their undisputed gadol hador (that could easily be a thing, but I wouldn’t know).
October 9, 2013 12:35 am at 12:35 am #978808Sam2ParticipantA Rebbe would generally be the Rav Muvhak of his Chassidim, so yes, they would tear Kriya.

This absolutely is also Halocho for Ashkenazim. Lamentably, I have seen many Availim with torn jacket but intact shirt, but it is not my job at a Shiva to grieve an Oveil, so I refrain from saying anything and hope their local Rov will correct them.
October 9, 2013 4:35 am at 4:35 am #978810NechomahParticipantFrom the pictures that I saw, I think you can’t see that their shirts have been torn because they all have pretty big beards that cover the area. The jacket obviously is more low and the cut is obvious to all.
October 9, 2013 5:31 am at 5:31 am #978811Avi KParticipantSam, with all due respect to Rav Ovadia’s gadlut, most National Religious Sephardim follow Rav Mordechai Eliahu’s pesakim. Many Jews of North African background follow Rav Mashash’s. Both disagreed with Rav Ovadia’s ruling that Sephardim in EY must follow the Mechaber 100% irregardless of the customs in their previous countries.
October 9, 2013 12:22 pm at 12:22 pm #978812Geordie613ParticipantThey probably wore tfilin at shacharis on the first day, as Rav Ovadia was niftar late in the morning/early afternoon. The next day was already the 2nd day
October 15, 2013 7:47 am at 7:47 am #978813NechomahParticipantAC – What does that have to do with anything? The levayah was at night and the kevurah was at night, so the “next day” – meaning the morning after the levayah – was the first day of the shivah still.
