Actually, I think there should be a DE, I just don’t think we can kill them on that one.
I think their position on English Muffins doesn’t make sense; I have written about this before. Maybe it’s because they’re zionists.

If something is truly DE and someone eats it for dessert of a fleshig meal all is OK. If the formula changes and it is truly a dairy product and one erroneously thinks it is DE is in my opinion a bigger problem than something which is truly DE but has a D and is never eaten until waiting the appropriate time.
This is a response to someone who wrote the OU doesnt use Pareve. I dont know their guidelines, but I am staring at packets of splenda and sweet and low both of which are labeled OU pareve.

That can actually happen if someone decides that something is really just DE without asking.
I am staring at a box of Cheerios which is 100% pareve but has a plain OU. I think it is the company’s choice.

And is more likely to happen to someone who followed the OU’s advice and asked every 3 months, and it changed within the 3 months. (And presumably has a spreadsheet with each item he asked about and the last time he asked, along with the past 50 years worth of OU emails and product alerts, which he consults each time he goes to the store like a good little O-U jew.)

The Orthodox Union certifies Golden Flake Hot Thin & Crispy Potato Chips as an OU product. A certified OU D product was mistakenly packed in the packaging of 5 oz. Hot Thin & Crispy Potato Chips, labeled with a plain OU. This product is being withdrawn from the marketplace.

I can only talk from local experience at my end. But it all depends on the supervisionary level – onsite mashgiach, or casual kashrut office inspection, and even personal practices. I want to say more but whats the point…
