Can someone please post the mekor for it, and its applications? Please try to keep this discussion on point, people, leave the tangents to other threads.
April 2, 2012 3:05 pm at 3:05 pm #865374shmoelMemberYou may, or are even possibly obligated to, kill a moser even bzman hazeh.
April 2, 2012 3:26 pm at 3:26 pm #865376HealthParticipantsoliek – It’s brought down in the Gemmorah and S’A. It’s a very bad Aveira. There are Heterim in certain instances. A Shaila should be asked in every case. I was about to say something Politically Incorrect & decided not to.
April 2, 2012 4:11 pm at 4:11 pm #865378soliekMemberthat’s exactly the tangent i was hoping to avoid. i want information about mesira because i dont know anything about the halacha, im not coming at this with an agenda.
“It’s brought down in the Gemmorah and S’A”
can you cite it please?
April 2, 2012 4:38 pm at 4:38 pm #865381apushatayidParticipantGo to torahanytime.com and look for lectures by Rav Oelbaum. There is one that offers practical halachic guidelines regarding this topic.
April 2, 2012 8:37 pm at 8:37 pm #865389yungerman1ParticipantA moser cant not be punished by us unless they are going to be moser again. The heter mentioned above is permitted to prevent a moser from giving over information. But if you know his mesirah is a one time deal, after he was moser we may not take matters into our own hands.
April 2, 2012 10:48 pm at 10:48 pm #865390sam4321Participanthilchos meisira is very complicated and a rov has to be consulted. A mosser has a din of a non jew (yoreh deah 281:3) it is a very bad thing to be a mosser. However when there are laws in the land and chillul Hashem then it becomes a diff story.(choshen Misphat 388:12).for halacha l’masseh a rov must be consulted and reglaim ldvar as well.
April 2, 2012 11:11 pm at 11:11 pm #865391soliekMember^that’s a start. Thank’s sam 🙂
April 3, 2012 1:39 am at 1:39 am #865392YehudahTzviParticipantUm, as a Chozer BTshuvah I need to ask: What is mesira? This is the first term in many many years that I do not understand and I’ve been frum for 25 years.
Thanks.
April 3, 2012 2:39 am at 2:39 am #865393stuckMemberYT: A moser is a snitch (informant).
April 3, 2012 3:14 am at 3:14 am #865394sam4321Participantmosser(give over) is a informer who gives over to non jews(simple def).
April 3, 2012 3:52 am at 3:52 am #865396YehudahTzviParticipantThanks!
April 3, 2012 4:27 am at 4:27 am #865400soliekMemberSo as I was saying somewhere else, I started this thread to get sources I could study over pesach. A few were posted above, and they are much appreciated. Are there any more I should know about?
April 3, 2012 4:42 am at 4:42 am #865402Dont Worry Be HappyMemberStuck -So it’s a grey area issue, with many, many factors to consider. That’s a really different story than simply killing a mosser on the spot. I actually assumed that was the case, but thought your comment needed some clarification. As Torah observant Jews, we understand that their is alot of nuance in every halacha and the way they are interpreted. But a casual reader of this site with little knowledge of Torah and the way our community operates could easily interpret a blanket statement about killing a mosser, that we as a community casually kill each other to protect our own interests. That’s obviously not what we do and we are required to follow the law of the land, it would be a terrible libel on our community if somebody walked away and assumed we kill at a whim.
April 3, 2012 5:25 am at 5:25 am #865405sam4321ParticipantSee meseches Bava Matzia 83b the story with Rabbi Elazar and the king and the Ritva on the issue of the law of the land. Also see Igros Moshe OC 5:9(11 in 9)meisira regarding a ganav who stole a sefer Torah and the silver. Kovetz Tshuvos (Rav Eliyashiv) 3:231,Shevet Halevi(2:58). Once again after reading all these mekoros this does not make someone a baki in this serious are of halacha.A Rov who is very familiar with this area can make a psak.

April 3, 2012 8:30 am at 8:30 am #865408soliekMemberI’m aware of that, sam, I just want to see them.
April 3, 2012 6:51 pm at 6:51 pm #865411polisha chosidParticipantits vital that the exact situation is totally understood…. as mentioned in an earlier posting… at Torahanytime.com there is a shiur given by HaRav Oelbaum that is quite clear…. messira to authorities can sometimes be a mitzvah when children or spouses are being victimised… enough said, again, every situation is unique and must be discussed with a Rav who understands the particular area in which events are unfurling. As in all halacha, questions must always be asked in seeking direction, however some Rabbonum have experiance in specific fields and are more proficient given the nuances involved.
April 3, 2012 7:34 pm at 7:34 pm #865414soliekMemberpolisha chosid: cna you give me more details about that shiur? i tried finding it but couldnt
