In light of the fish-in-worm tumult, which has brought kashrus into the limelight once again, I thought that there was another issue which needed attention.
Recently AKO released a list of whiskeys which they have determined to be considered “chometz she’uvar uluv es ha’pesach” based upon their own investigation. Last week i walked into a frum owned wine store and asked if they had the list from AKO. The look I received from the employee (frum)was one of disdain! As I continued shopping I recognized one of the whiskeys from the “forbidden list” sitting on the shelf waiting to be purchased.
I have two points to make.
1) Why are the frum wine/liquor stores continuing to sell these whiskeys, which have been determined by a reputable Kashrus organization to be assur b’hana- forbidden to have any benefit from them?
2)Why the “look” from a frum employee when someone is trying to do the right thing

b) I learn in BMG, and many of my very ehrliche friends who follow the standard Lakewood Rabbonim are ignoring ‘the list’, so I assume their rav told them it’s fine too.
I don’t know exactly what the argument is about, but clearly there is what to be dan l’kaf z’chus for a kosher store-owner who still sells the booze on ‘the list’. He should still respect your wishes to abide by whatever your own rav tells you, and he should not be showing disdain.

Forgive me, as I am quite ignorant when it comes to alcohol (I don’t drink), so this may be a stupid question… but here goes.
Since it’s already well after Shavuous, why do you think the whiskey on the shelf today is from before Pesach?

Perhaps as Wolf said
Perhaps they hold by a different Kashrus organization
Perhaps it was an (almost)unavoidable mistake
Perhaps there is another reason which they could explain to you

Perhaps you misunderstood the “look”
Perhaps even you read the look correctly, it was in response to something he perceived as unwarranted in your behavior

The problem with whiskey is that it is aged many years. Lets say a store is selling an 8 year old whiskey, the question is were all 8 Pesachs done properly. With many companies this is not an issue. However, some of these ARE Jewish companies (Segrams is a Jew IIRC) and thus one needs to ensure that the whiskey he/she is drinking was sold every pesach.
The question is NOT how long it has been in the possession of the store, or what they did with it this past pesach, the issue is the life of whiskey in the bottle.
Keep in mind due to aging the questions regarding alcohol are much different than the usual questions regarding a Waldbaums or a Pathmark
