Does anyone know the Get law in Israel… specifically, if wife wants Get, is it pretty much a given the husband has to give her one like it is in NY State or face financial penalties or in Israel, jail time? Or is it where wife has to prove the husband beat her, cheats on her or one of the other halachic reasons? Seems like religious Judiasm has moved to divorce on demand; just wondering if different in Israel? thanks

June 22, 2018 9:53 am at 9:53 am #1545032JosephParticipantIf the husband must give the Get under New York, Israeli or any other secular law under penalty of finances or imprisonment, and does so for that reason, then the Get is halachicly invalid and is as if it was never given.

It’s pretty much established and accepted that the Jewish establishment has gone divorce-on-demand. Their halachic basis is alleviating the woman’s suffering in a marriage she doesn’t want to be in trumps all else. I’m asking how the Gett process works in Israel. What exactly is the threshhold the Butei Dinim use for ordering a Gett. In the U.S., it’s definitely divorce on demand. Thanks and good early Shabbos.

June 22, 2018 10:52 am at 10:52 am #1545055JosephParticipantHalacha does not permit a Beis Din to order a Get be involuntary given in the absence of a basis specifically and directly outlined by Chazal and Shulchan Aruch where a Get is mandatory under Halacha.
This same Halacha applies to both the US and Israel.

The husband has to give a Get or else the consequences are quite severe. We’re no longer living in Biblical times. Nowadays, women have the right to demand a divorce. The Rebbeim and butei dinim will almost always back us up. It doesn’t matter if the husband is cruel or even at fault or if the wife just has no interest in the marriage continuing. What matters is the woman is not considered some man’s property anymore.”
