Rav Amar: Rabbanut Decision Not Applicable to Organ Donations


amar1.jpgIn response to widespread media reports that the Chief Rabbinate Rabbinical Council ruled to relax restrictions pertaining to organ transplants, Sephardic Chief Rabbi HaGaon HaRav Shlomo Moshe Amar Shlita announced the decision simply does not pertain to transplants, in one having a question regarding transplants, one must ask a question – each case on its own merit.

Rav Amar told the chareidi Kav HaChadash news service that the decision of the council pertains only to a declaration of death, adding his position is well-known, that pertaining to organ donations, he remains opposed. He stressed regarding organ donations, each case must be evaluated on its own to avoid confusion chas v’sholom in such a critical halachic matter.

Regarding gedolei hador shlita, Maran HaRav Elyashiv Shlita and Maran Rav Yosef Shlita, he stated Rav Elyashiv was opposed, but added if explained some of today’s new developments, he believes the rav might change his position. The rav explained that the exams to make the determination today are far more advanced than in the past, including a respiratory test that did not exist in the past, a test which complies with the teachings of gemara.

He added Rav Ovadia Yosef approved over the Chief Rabbinate decision.

The rav closed the interview with a call to Am Yisrael to increase tefillos during these special days and davens we should merit seeing the geula.

  1. Whats the nafkimina? You loosen the definition of “death” for the people who pull the plug, and then the shila becomes whether or not someone is allowed to accept an organ that comes from retzicha?
