High Court Refuses to Delay Wallis’ Sentence


court hammer6.jpgThe High Court of Justice on Tuesday declined a request to delay the prison sentence of Yisrael Wallis, the chareidi dad who was found guilty of contributing to the death of his infant child by violently shaking the baby, resulting in his head striking a wall.

As was reported by YWN, many turned out as character witnesses in an effort to assist Wallis in his trial, but others are angered at the willingness of the chareidi community to come to his aid when in fact, his actions led to the death of an infant.

Wallis was found guilty and sentenced to six years in prison by the Jerusalem District Court, and he appealed to the High Court in the hope of delaying the start of his sentence pending an appeal. Justice Israel Danziger ruled the appeal would be heard but nevertheless, Wallis must begin serving his prison sentence in January 2009.

Prominent attorney Avigdor Feldman tried to persuade the court to delay the sentence without success. The court stressed the district court ruled he was guilty in the manslaughter death of his son.

Justice Danziger did state however that he is instructing the court clerk to see to it that the appeal is heard at the earliest possible opportunity.

  1. All a character witness accomplishes is to be meorer rachamim from a judge, that he isn’t the end of the world. They in no way excuse, justify, condone, or brush under the carpet the severity and importance of the charges.

    The critics weren’t upset with the character witnesses of the haimishe oilam. They were upset with the machinations and maneuvering of some chareidi heavyweights to drop charges. This is looked as an attempt to sweep things under the rug, which has no place in Yiddishkeit.

    Pikuach nefesh is a greater mitzvah than pidyon shevuyim. When a person perpetrates a crime against a persons life or well-being, pidyon shevuyim is misplaced rachmanus, and cheapens the crime and the impact on the victims. Had the fellow been charged for this crime in Los Angeles, Cleveland, or Chicago he would have gotten a much more severe sentence. Six years for murdering your own flesh and blood is true rachmanus from the judge.

    So, obviously, he could be totally innocent. There is no clear proof of foul play here.

    The secular judge, faced with a choice of believing a medical doctor who stated that the baby was not mishandled, and a brand new doctor, who was brought in by the Police 12 months later, after they failed to prove wrongdoing the first time around, chhose to go with the very suspicious newfound doctor.

    If that isn’t anti-Hareidi bias, I’ll eat my hat.
