A new state law that would fine pesky flyer distributors is “unenforceable” because it doesn’t spell out who would write the tickets, said NYC Councilman Simcha Felder. “As it stands now it’s almost like saying this is a terrible thing, we must do something about it and we are going to give out [the] fines – without explaining how it would take place.”
Felder said he wrote a “perfect” city law (as reported HERE on YW) that would have mandated that Mayor Bloomberg choose an agency to give out the $250 to $1,000 fines. But before Felder’s bill could come to the floor, the state Legislature passed its own law in June.
The state law bans businesses from leaving circulars if homeowners have posted a “no flyers” sign. What the law failed to specify is who will enforce the fines.
“Literally, right now it’s unenforceable because of the original version of the law,” said Felder.
An amendment that will allow the mayor to pick a city agency to enforce the law will be voted on when the Senate reconvenes in a few weeks said one of the bill’s sponsors, state Sen. Frank Padavan (R-Queens).
The city wanted “more specific language,” Padavan said.
But for now, the law is dormant with no one writing the actual tickets.

Our home continues to be deluged with flyers, unwanted newspapers (often 5 of the same)and business cards stuck in the door jam that invariably
fall to the floor.
It doesn’t surprise me that the new law isn’t being
enforced; neither are the “poop scoop” law, the anti
noise laws, the cell-phone-while-driving law, the
illegal driveway laws or other quality-of-life laws
being enforced. Brooklyn is “hefker.”

Take a flyer and send a ticket to the advertiser…. I think they will get the message
