8th Circuit Court Of Appeals Will Hear New Trial Arguments Of Sholom Rubashkin


A hearing seeking a new trial for a former Iowa kosher slaughterhouse executive convicted of financial fraud is scheduled before the U.S. 8th Circuit Court of Appeals.

Documents filed Monday show a hearing before the St. Louis court is set for June 15.

Former Agriprocessors Inc. manager Sholom Rubashkin was convicted of financial fraud in 2009 and sentenced to 27 years in prison. His arrest followed an immigration raid at the company’s Postville plant in 2008.

His attorneys sought a new trial after evidence showed Chief U.S. District Court Judge Linda Reade, who presided over Rubashkin’s trial, was involved in the planning of the raid. Rubashkin’s attorneys argued Reade could not be impartial and should have recused herself.

Reade rejected the request and Rubashkin’s attorneys appealed to the federal court.

    Although true, its not an accurate assessment of the court record. According to the court record it shows:

    1. Yes there was a motion asking Judge Reade to recuse herself;

    2. The motion was denied;

    Now for the problem:

    3. The motion was not made by Rubashkin’s lawyers, IN FACT, Rubashkin’s lawyers declined the invitation to be party to the motion.

    Which leaves the question as to why Rubashkin is being allowed to appeal an issue He was not party to?
