Restaurant Sued 7 Million Shekel Over 2nd Hand Smoke


2nd hand smoke.jpg(From Haaretz website:) A lawsuit was filed in the amount of NIS 7 million against a restaurant with the Jerusalem District Court on Sunday, for allowing its customers to smoke in breach of the law.

One of the complainants, has already sued the restaurant for the same offense in the past and was awarded NIS 1,300. The plaintiffs claim the restaurant owners have continued to ignore the law while disregarding customers’ complaints.

Ash trays are on the tables, smoking signs are nonexistent and no separate smoking area has been designated, the plaintiffs claim.

They claim that the Supreme Court ruling caused a precedent that lead to the fining of other restaurants of sums between NIS 1,000 and 4,000 for each person exposed to cigarette smoke.

As a result, they are asking each non-smoking customer that ate at the establishment between May and June 2007 be given a similar sum.

They added their goal is not to make a profit, but enforce the rule of law and put an end to passive smoking that increases risks of developing cancer.

  1. ill bet the judge went for a smoke during this trial. and if he ate at this restaurant he was probaly the one who smoked indoors. its like the candyman giving out bussiness cards to the dentist and vice versa

  2. Bravo! I know how second hand smoke hurts.Those who smoke don.t realize how much non-smokers suffer from it. I should have the same right to spray a can of roach spray in someone;s direction because I like the smell. ,just like the smoke that he likes blows in my face. Now that there are LAWS to protect those who don’t want to suffer,the laws are only worth something if they are enforced. It will take time,but they ‘ll get used to it.Old habits take a long time to die.

  3. Uch its disgusting what goes on in israel in regard to second hand smoke. They don’t care (most people) and if they do – they will try to blow it away from you. SMOKING KILLS and this is a big step in preventing it in the 5th world country that we live in… ISRAEL.
