An emergency medical technician who is accused not of doing nothing while a pregnant woman died inside a Brooklyn Au Bon Pain restaurant last year is set to face criminal charges.
Melissa Jackson, 23, is expected to turn herself in today. She is charged with official misconduct and faces up to two years behind bars.
Another EMT involved in the incident, Jason Green, was shot and killed in July.
Witnesses say Jackson and Green, who were off-duty, refused to step in as Eutisha Rennix, 25, was dying of an asthma attack.
Jackson’s lawyer maintains his client did nothing wrong and actually called the 911 dispatcher directly.
Both Rennix and her unborn child died at the hospital.

I was not aware that an off-duty EMT can be compelled to treat someone.
When I was training to be an EMT, I was taught that private citizens (which is what an off-duty EMT is) are not legally required to aid ill people (notwithstanding any moral considerations). However, admittedly, that was many years ago. Has the law since changed?

If I am not mistaken trained emergency personnel – doctors, nurses, emts, etc. are held to a higher standard as bystanders and are obligated to assist. Why the pair of them didn’t initiate CPR is a mystery – unless they didn’t want their cappucinos to get cold.
