Substitute store owners for homeowners and you have a truly parallel situation. Plenty of my friends who have retail locations are in violation of some technicality and may or may not know it, but because no one moisers them and there is no real health hazard even if there could be a nuisance, they are not harassed by inspectors.
The law is so arbitrarily enforced when it comes to technical health, building etc code violations that the only way to get busted in NY is usually when a moiser rears his ugly head (or when you want to sell or insure a property and find out that you have a violation that you did not know was such).
