A Brooklyn mother is suing over a cup of scalding tea that she claims severely burned her infant son at a Starbucks.
Villona Maryash claims the tea was “improperly served” without a protective sleeve.
Maryash’s suit, filed in Brooklyn Supreme Court yesterday, stems from an incident last Oct. 9 at the Bensonhurst Starbucks. Her 5-month-old son, Arnold Glouchko, was next to her in a stroller.
While she waited for the rest of her food order, she went to take a sip of the tea, she said.
When she picked up the cup, it was so hot that she dropped it, and the contents spilled over her son, causing “serious injuries,” said her lawyer, Martin Garfield.
He said the tea should have been served on a tray and with an insulating sleeve.
“This cup was improperly served, and that’s the reason my client dropped it on her baby,” he said.
There was no immediate comment from Starbucks.
In May a Manhattan customer sued Starbucks for serving him “unreasonably hot” tea in a container that was “not safe. He claimed he suffered “great physical pain and mental anguish.”

Lets thank Team Obama & his policies for bringing out all the wakkos.
Tea is hot. When you ask for a hot tea, it will be hot. I am sure this wasn’t any hotter than the tea or coffee they normally serve.
I despise Starbucks coffee but I hope they win the case!
shlamiels like this need to find something else to drink instead of wasting the time of the courts
#1 wouldn’t it be interesting if this person was actually a “tea” party member? (then your assertion would make you into the wacko)
This is blamed on Obama? Are you SERIOUS?!
Crazy country, where people sue over such things.
They should bring her to court for child endangerment.
re#1:
as much as i dont like obama, not everything is his fault.
#1- if it was as hot as she says it was when she took it to take a drink, why did she not notice when they handed her the cup? she should have asked for a sleeve and/or tray immediately.
#2- why was she drinking a hot drink right over her baby in the first place? when i have a hot drink and i am with my baby, i push the stroller away from me a little bit, so that if some spills for any reason, it wont get on the baby.
#3- i seem to remember quite a few cases when i was in high school (quite a few years before obama came into office)of people trying to claim that burger king/mcdonalds drinks were too hot and had caused severe injury. many of those cases were thrown out.
if this creep doesnt have enough brains not to open a scalding hot cup of anything over or near a child,or even a grown as accidents like this happen, she shoudnt have children. She shoudve been arrested for endangering welfare of a minor, and that what the defense lawyer should go for
4 (RavBaruch),
You missed the boat. It set sail without you.
Whenever the economy tanks, like it has COURTESY OF BARACK HUSSEIN OBAMA, these frivolous lawsuits end up on the rise as people look to make a quick buck.
Some people always knoe hoe the throw the blame on someone.
But I’m quite sure, that in this justice lacking country, shell win it…
Some questions for the liar, I’m sorry I mean lawyer, handling this case:
1. This “happened” on Oct 9th. The suit was filed on July 2nd, some NINE months later! What happened, the parent burnt the kid and it took them time to figure out whom to sue?
2. She lifted a HOT tea OVER her kid to drink it. Just for that she should be deemed AN IDIOT.
3. “The tea should have been served on a tray and with an insulating sleeve.” Oh, so she would have left the tray attached to the cup so she could drink it that way? Of course, we all walk around drinking tea and coffee like that. Don’t we? NOT!!!!
4. “This cup was improperly served, and that’s the reason my client dropped it on her baby,” he said. No, the reason SHE dropped it on her baby is because she was NEGLIGENT and SHE took the cup of HOT liquid and HELD IT OVER HER BABY so SHE could drink it, instead of NOT holding it over her kid, like NORMAL people would do.
This is a frivolous lawsuit and should be tossed out of court. I hope the store’s video, if there is video, makes this mother look like the miscreant she really is.
of course you realize the real Mark levin (on radio) is a liar, I mean lawyer
#12 no, i dont realize mark levin is a liar
